The judgment was executed by the deputy sheriff and his staff. <o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0in;margin-bottom:.0001pt;text-align: justify"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-bidi-font-family:"Courier New"">The Applicant/Respondent (hereafter referred to as the Respondent) on 5<sup>th</sup> March, 2010, filed an application for committal for contempt against the Respondent herein who are husband and wife respectively as having forcibly re-entered and erected structures on the land in disputed after execution.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0in;margin-bottom:.0001pt;text-align: justify"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-bidi-font-family:"Courier New""><o:p> </o:p></span></p><p class="MsoNormal" style="margin-bottom:0in;margin-bottom:.0001pt;text-align: justify"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-bidi-font-family:"Courier New"">The respondents therein filed an affidavit in opposition on the 23<sup>rd</sup> day of November, 2010. On the 21<sup>st</sup> day of June, 2011, the appellant’s new solicitor prayed the trial court to file fresh affidavit in opposition to the application for contempt since the earlier one was defective.
