line-height:115%;font-family:"Book Antiqua",serif">We noted from the record of appeal that no additional grounds were filed.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><b><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif">Brief Facts<o:p></o:p></span></b></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua",serif">The Plaintiff/Appellant until 4<sup>th</sup> May, 2009, was a tenant in a store Number 15A in Angelina House Accra, opposite the Makola-Market.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua",serif">The 1<sup>st</sup> Defendant is the owner of the said store 15A and the Appellant’s Landlord, while the 2<sup>nd</sup> Defendant is the Deputy Sheriff of Accra responsible for the execution of judgments. Originally, the Appellant was the tenant of J. K. Siaw, (deceased) in shop No. 15.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua",serif">In 1979 the said property, Angelina House, was confiscated by the State. The children of J. K. Siaw (deceased) petitioned the Commission on Human Rights and Administrative Justice (CHRAJ) that the confiscation was wrongful. On 2<sup>nd</sup> October, 1995, CHRAJ ruled in favour of the Children and de-confiscated the property called Angelina House. The property was shared among the children of J. K. Siaw (deceased). <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua",serif">The Appellant’s shop numbered 15 was then demarcated into two 15A and 15B and allocated to 1<sup>st</sup> Defendant and her sister Yaa Adjubi Siaw respectfully. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua",serif">On the 4<sup>th</sup> day of May, 2009, the 1<sup>st</sup> Defendant had a judgment against the Appellant for the recovery of shop No. 15A in the case of <b>Cecilia Ohenewaa Siaw v Nana Kwaku Asubonteng I. </b>On the 15<sup>th</sup> day of December, 2009, the 2<sup>nd</sup> Defendant ordered the execution of the judgment by removing all the items in both shops Nos. 15A and 15B and gave possession to 1<sup>st</sup> Defendant/Respondent. The execution, according to the Appellant, was wrongful, hence the action instituted on the 30<sup>th</sup> day of December, 2009. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua",serif">The Appellant felt that the execution should have affected only store No. 15A but not 15B because the judgment obtained by the Respondent was in respect of shop No. 15A, belonging to the 1<sup>st</sup> Defendant/Respondent.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua",serif">On the 28<sup>th</sup> day of June, 2010, the Defendant/Respondent filed a Motion on Notice to dismiss Plaintiff’s action as frivolous.
