The twelve stores on completion were to be shared equally between the Plaintiff and the late Emmanuel Adotey Akueson. <o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0in;margin-bottom:.0001pt;text-align: justify"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-bidi-font-family:"Courier New"">Based on that understanding, the Plaintiff demolished the old building and started the construction of the Block of twelve permanent stores. Six (6) stores on the ground floor were completed by the Plaintiff and rented out to tenants for ten years at a total rent of GH¢18,000.00 and paid to the late Emmanuel Adotey Akueson. Unfortunately, before the agreement between them could be reduced into writing, the said Emmanuel Adotey Akueson died. <o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0in;margin-bottom:.0001pt;text-align: justify"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-bidi-font-family:"Courier New""> <o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0in;margin-bottom:.0001pt;text-align: justify"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-bidi-font-family:"Courier New"">Letters of Administration in respect of the estate of the late Emmanuel Adotey Akueson were granted to the Defendant who was then resident outside Ghana. Defendant initially gave a Power of Attorney to the Plaintiff to manage the stores and other properties belonging to the late Emmanuel Adotey Akueson. Before the agreement could be discussed, the Defendant revoked the Power of Attorney and instructed the tenants in the stores not to have any dealing with the Plaintiff.
