She claimed that the land forms part of the larger land belonging to Virginia Aryee’s father Francis Aryee, a royal of Asere Stool who had earlier on gifted the land to Virginia Aryee. Her mother Virginia Aryee registered her land as number 841/1952 in 1952.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua","serif"">It is her case that defendant is religious body whose branch members are based within the area of the land and have trespassed unto the land by constructing a temporary place of worship and an uncompleted building. The defendants have since destroyed the corner pillars planted on the boundary by her mother and also destroyed the foundations constructed by the mother. When the defendant defied warnings to leave, she issued this writ.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua","serif"">The defendant/respondent virtually denied all the averments of plaintiff and further explained that she acquired the land from Henry George Annan and has since obtained land Title Certificate No. GA26715 of volume 32 Folio as evidence of their legal and equitable interest. It is the case of the defendant/respondent that all diligent search was done at various institutions before acquiring the land. It is interesting and pertinent to note that both parties have produced documents to evidence their ownership to the land. The plaintiff traced her root of title to 28<sup>th</sup> March 1952. The defendant showed their root of title dating 1944 and further relied on the land title certificate and that being so holds an indefeasible title.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua","serif"">In the light of these divergent claims the court was called upon by the plaintiff/appellant to impose an injunction on the defendant church to restrain it from further developing the land until the rights of the parties were determined. At page 50 of the record of proceedings is found the ruling of the court below;-<o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify"><i><span style="font-size:12.0pt;line-height: 115%;font-family:"Book Antiqua","serif"">“I have read the motion paper and the Supporting Affidavit as well as the Supplementary Affidavit together with its annexures. I have equally read the Affiadavit in Opposition and the annexures thereto.<o:p></o:p></span></i></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify"><i><span style="font-size:12.0pt;line-height: 115%;font-family:"Book Antiqua","serif"">Now, having regard to the pleadings filed in the case and the respective arguments of both counsel as canvassed in the Statement of Case filed by both lawyers, I think it shall not be just and convenient to grant the instant application. In the circumstance the application is refused.”<o:p></o:p></span></i></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua","serif"">The trial court refused the application for injunction on the grounds that it will not be just and convenient to do so. It is the refusal to grant the application which led to the present appeal now before us.
