line-height:115%;font-family:"Book Antiqua","serif"">The facts of the case have been spelt out clearly in the statement of claim as well as the judgment and written submissions. We shall however briefly restate the facts for the purpose of this judgment.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua","serif"">The plaintiff appellant who was a Major in the Ghana Armed Forces permanently retired from the military and got himself employed with the defendant/respondent Mining Company as an Asset Protection Superintendent with the Asset Department with effect from 1<sup>st</sup> June 2008 as contained in the offer of appointment letter which can be found at page 17 of the record appeal. The said letter is dated 27<sup>th</sup> May 2008.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua","serif"">By this letter appellant’s appointment was to be effective on the day he actually assumed duty or on the date he was declared medically fit by the medical authorities of the company, which of it was later.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify">
