KORBIEH, J.A. <o:p></o:p></span></b></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">In order to understand fully and appreciate the appeal that is before us, we need to do a recap of the facts leading to the appeal. But as I go on to narrate the brief facts of the case, I will make comments that I consider to be relevant to any particular fact. On the 16/1/2012, the applicants/respondents (hereinafter referred to only as the respondents) issued a writ of summons accompanied by a statement of claim against five defendants of whom the respondent/appellant (hereinafter referred to only as the appellant) was the 5th defendant. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">The reliefs sought from the court as endorsed on the writ of summons were as follows: <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">a) A declaration that the purported sale of the family property comprised of Plots Nos. 103 and 104, situate, lying and being at Adabraka, Accra, otherwise described as H/No. D 554/4, Kojo Thompson Road, Adabraka, to the 5th Defendant by the 2nd and 4th Defendants is null, void and of no legal effect. <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">b) A declaration that the sale of the aforesaid family property was wrongful and fraudulent. <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">c) An order of annulment of the purported sale of the said family property. <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">d) An order of recovery of possession of the said family property. <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">e) General damages for wrongful and fraudulent dealing with the aforesaid family property. <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">f) General damages for trespass to the said family property. <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">g) Perpetual injunction to restrain the Defendants, whether by themselves or whomsoever of whatever description, from dealing with the property in any manner whatsoever. <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">h) Any further or other orders, inclusive of costs. The defendants duly entered appearance through a common lawyer and filed a common statement of defence through that same lawyer. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">They denied liability for any of the claims made by the respondents against them. It is therefore beyond dispute that the appellant herein was aware that there was a suit pending against him and others before the High Court and that some of the reliefs sought tried to ensure that the nature of the disputed property was not altered. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">On the 29/8/2012, the respondents filed a motion for interlocutory injunction seeking to restrain the 5th defendant (the appellant herein) from exercising any ownership rights over the disputed property. The application was brought before Alhaji Abdullah Iddrissu, J. who gave his ruling on the 22/10/2012. He dismissed the application citing the failure of the applicants therein to comply with the provisions of Order 25 rule 9(1) of C.I. 47. In the said ruling he referred to an earlier application that had came[sic] before P. Bright Mensah, J. and that had been opposed by the appellant.
