My full name is Samuel Arthur. I live at Pantang. I am on retirement. I know the petitioner is my wife. I agree that the marriage be dissolved. I deny that I have neglected the children. The children are adults. All six children are adults. The last one is 20 years old. The children are with their mother in the United Kingdom. I deny that I have been violent and assaulting her throughout the marriage. I deny that my wife is having ear and eyes problem due to my assaults on her. I deny that petitioner has incurred a debt of £128,000 because I have not been looking after the children. On the contrary I have been supporting the children wherever I can. As a couple we have acquired properties. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">We have acquired shops, two self-contained at Dome, Accra. It is not true I have collected ¢15 million old cedis from the shop and enjoying same alone. The shops were uncompleted and I used the ¢15 million to complete same. The petitioner wants custody of the children but I say they are all adults. I don't owe the petitioner £128,000 being expenses on the children as alleged by petitioner. I am not in a position to pay £3,000.00 per month for the upkeep of the children since I am on retirement. I am not in a position to pay GH¢70,000.00 as financial provision. I am on retirement. I say that House No. DM/17, Dome is jointly owned by us and I do not agree that it should be given to the petitioner alone. I have built a church house for petitioner and three-bedroom on Plot 16, Dome for petitioner. Respondent tendered as Exhibits 1, 1A and 1B. I agree that the shops on Plot No. 20 i.e. 6 shops be shared equally. I do not agree that I should pay for the cost of this action. Each party should bear his or her own costs. Marriage Certificate is tendered as Exhibit 2. The original certificate is with the petitioner. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">The petitioner is now domiciled in the United Kingdom. Plot 17, Dome is the matrimonial home. I do not live there. An injunction has been granted against me not to go to Plot No. 17. We have been living apart for the past 8 years since 2006. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><b><u><span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua","serif"">BY COURT <o:p></o:p></span></u></b></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">After listening to the evidence of the Respondent I am satisfied that the marriage between the parties celebrated in the United Kingdom has broken down beyond reconciliation as parties have not lived as man and wife for the past 8 years. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">House No. DM 17 is the matrimonial home. The parties are to own the matrimonial home in equal shares. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">The shops on Plot No. 20 should be shared equally, three shops for the petitioner and 3 shops for the Respondent.
