Y. Adadevoh acting as caretaker, let the house to the 1<sup>st</sup> defendant for a term of ten years. The plaintiff pleaded that he gave six months’ notice of his intention not to renew the tenancy as it was his intention to pull down the building and reconstruct a new edifice. The reason being that the place is prone to frequent and periodic floods and has become a Central Commercial location. Additionally, the defendant has not paid rent for four years and has also been using the premises let as dwelling house for business purposes.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0in;margin-bottom:.0001pt;text-align: justify"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-bidi-font-family:"Courier New"">The plaintiff further pleaded that the defendants, without his authority or consent, carried out extensive re-construction of the property thereby weakening, defacing and damaging the structural, architectural and aesthetic beauty of the property.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0in;margin-bottom:.0001pt;text-align: justify"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-bidi-font-family:"Courier New"">In course of time<i>, </i>the 1<sup>st</sup> defendant, who had unlawfully mounted a mast on the building informed the plaintiff that she was assigning her interest to the 2<sup>nd</sup> defendant contrary to their tenancy agreement to give him particulars of the assignment.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0in;margin-bottom:.0001pt;text-align: justify"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-bidi-font-family:"Courier New"">The plaintiff further bemoaned the fact that the defendants have failed to have the rent reviewed contrary to their tenancy agreement hence he claimed for the following reliefs:<o:p></o:p></span></p><p class="MsoNormal" style="margin-top:0in;margin-right:0in;margin-bottom:0in; margin-left:.5in;margin-bottom:.0001pt;text-align:justify;text-indent:-.5in"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-bidi-font-family:"Courier New"">1) an Order for recovery of possession of House No. C 263/3 Ring Road Central, Accra, as the legal title and beneficial owner.<b> <o:p></o:p></b></span></p><p class="MsoNormal" style="margin-top:0in;margin-right:0in;margin-bottom:0in; margin-left:.5in;margin-bottom:.0001pt;text-align:justify;text-indent:-.5in"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-bidi-font-family:"Courier New"">2) an Order against the defendants jointly and severally to vacate the premises and give vacatant possession of same.<o:p></o:p></span></p><p class="MsoNormal" style="margin-top:0in;margin-right:0in;margin-bottom:0in; margin-left:.5in;margin-bottom:.0001pt;text-align:justify;text-indent:-.5in"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-bidi-font-family:"Courier New"">3) An Order terminating the lease agreement executed by Edwin T.
