It was the Respondent’s case that her mother who died on 2<sup>nd</sup> November, 1990, acquired the land from the Nungua Stool in the late '70s. She obtained a lease agreement from the Nungua Stool in 1979 and registered same in 1992. <o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0in;margin-bottom:.0001pt;text-align: justify"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-bidi-font-family:"Courier New"">After the mother’s death, she noticed that someone kept removing the pillars that her mother had put in place on acquisition of the land.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0in;margin-bottom:.0001pt;text-align: justify"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-bidi-font-family:"Courier New"">The respondent constructed a two-room structure on the land and put in two caretakers to live in the said structure. She got to know Dr. Maxwell Appeagyei, the 1<sup>st</sup> Defendant/appellant when he started development on the land. 1<sup>st</sup> Defendant brought in blocks, sand, chippings and constructed a wooden structure on the land. They locked up a reservoir which respondent had constructed. After the suit, the appellant continued to develop despite several warnings.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0in;margin-bottom:.0001pt;text-align: justify"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-bidi-font-family:"Courier New"">The respondent denied that the land belonged to the Ashong Mlitse Family – and also denied that her grantor had been destooled ten (10) years before she was granted the land.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0in;margin-bottom:.0001pt;text-align: justify"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-bidi-font-family:"Courier New"">During cross-examination, respondent reiterated that when the Chief, Nii Odai Ayiku gave her mother the document he was still a chief.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0in;margin-bottom:.0001pt;text-align: justify"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-bidi-font-family:"Courier New"">She stated that she did not obtain a permit to put up the boys quarters.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0in;margin-bottom:.0001pt;text-align: justify"><b><span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua",serif;mso-bidi-font-family:"Courier New"">The Defendants/appellants</span></b><span style="font-size:12.0pt;line-height:115%; font-family:"Book Antiqua",serif;mso-bidi-font-family:"Courier New""> <b>(hereinafter referred to as the appellants)</b> on the other hand claimed that they had been in effective physical possession of a greater part of the parcel of land inclusive of the land in dispute since 1997. Their case is that the land in dispute is situate at Adjiringano and that it belongs to the Ashong Mlitse Family of Teshie who have been adjudged by the Court of Appeal as the allodial owners. They contended that the purpose of acquiring the land was for the construction of a Nursery School. A lease was subsequently executed in their favour. The appellants denied the presence of corner pillars belonging to the respondent on the land and stated that they (the appellants) went into possession of the land and placed corner pillars, sand, stones and blocks on the land and built a wooden shed.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0in;margin-bottom:.0001pt;text-align: justify"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-bidi-font-family:"Courier New"">They also cleared the land in readiness for construction whilst waiting for their building permit and land certificate.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0in;margin-bottom:.0001pt;text-align: justify"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-bidi-font-family:"Courier New"">After the trial, the court found for the respondent and granted recovery of possession, perpetually restrained the appellants from, in any manner, interfering with the respondent’s occupation and possession of the disputed land.
