Though the land was not serviced as advertised, the respondent, upon the assurance of the defendants hereinafter referred to as defendant/judgment/debtor’s went ahead on 18<sup>th</sup> May 2007 to pay an initial deposit of USD20,000. This payment was duly receipted by the defendants/judgment/debtor.<o:p></o:p></span></p><p class="MsoNormalCxSpMiddle" style="text-align:justify;line-height:150%"><span style="font-size:12.0pt;line-height:150%;font-family:"Book Antiqua",serif"> </span></p><p class="MsoNormalCxSpMiddle" style="text-align:justify;line-height:150%"><span style="font-size:12.0pt;line-height:150%;font-family:"Book Antiqua",serif">Subsequently a contract of sale of land was executed between the two parties on 30<sup>th</sup> June 2007. In the agreement the defendants/judgment/debtor agreed to sell one hundred and four (104) plots to the plaintiff/respondent at the cost of USD291, 200.00. The plaintiff/respondent made part payments totaling USD111,200.00 to the defendant/judgment/debtor which was duly receipted.<o:p></o:p></span></p><p class="MsoNormalCxSpMiddle" style="text-align:justify;line-height:150%"><span style="font-size:12.0pt;line-height:150%;font-family:"Book Antiqua",serif"> </span></p><p class="MsoNormalCxSpMiddle" style="text-align:justify;line-height:150%"><span style="font-size:12.0pt;line-height:150%;font-family:"Book Antiqua",serif">The defendants/judgment/debtor’s in the agreement undertook to ensure the provision of water, electricity, road networks and other social amenities associated with serviced plots. Upon waiting for a considerable period of time without the defendants/judgment/debtor’s fulfilling their promise to enable respondent to start his development, he decided to go for the refund of the USD111, 200.00 he had paid.<o:p></o:p></span></p><p class="MsoNormalCxSpMiddle" style="text-align:justify;line-height:150%"><span style="font-size:12.0pt;line-height:150%;font-family:"Book Antiqua",serif"> </span></p><p class="MsoNormalCxSpMiddle" style="text-align:justify;line-height:
