The issue which the trial judge determined in that ruling is whether or not the plaintiff/respondent (hereinafter called plaintiff) was estopped from mounting this action against the defendant/appellant (hereinafter called the defendant). The plaintiff petitioned Commission for Human Rights and Administrative Justice for redress. The plaintiff discontinued the petition in order to apply for an order of certiorari to quash his dismissal by way of judicial review. But by then he was out of time to file the application directly. Dissatisfied with the grant of the extension of time to file an application for judicial review to quash the dismissal of the plaintiff, the defendant appealed to the Court of Appeal against the grant. The plaintiff continued to occupy the bungalow even after his dismissal despite the defendant’s request to him to vacate it.
