It is engaged in the business of mining services for the mining industry. It has over the decades been in a symbiotic relationship with the Defendant/Applicant/Appellant hereafter referred to as the Defendant. Both companies do their business mainly at Obuasi from where they operate. Under the said Separation Agreement Exhibit “KE 1”, the parties agreed to a mutual separation from any existing presumed, actual or legal relationship between the Plaintiff and the Defendant on the terms and conditions contained in the said Separation Agreement.
