The application, according to the applicant, is brought under the inherent jurisdiction of the court. The reasons for the application are stated in the motion paper and elaborated in the affidavit in support as well as the supplementary affidavit attached. The plaintiff is opposed to the application and has accordingly filed an affidavit in opposition.<o:p></o:p></span></p><p class="MsoNormal" style="margin-top:0cm;margin-right:-2.3pt;margin-bottom: 0cm;margin-left:0cm;margin-bottom:.0001pt;text-align:justify"><span lang="EN-GB" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-bidi-font-family:"Times New Roman"">Before considering the merits of the application it is important to point out that the writ of summons was issued and filed on the 9<sup>th</sup> day of March, 2015. The writ was served on Glo Mobile but returned to the Registry under cover of a letter dated 24<sup>th</sup> March, 2015 with the reason that the 1<sup>st</sup> defendant was unknown to the recipient company. This prompted the plaintiff to amend the writ on the 6<sup>th</sup> May, 2015 wherein the name of the 1<sup>st</sup> defendant was changed from Globacom Ghana Limited to Globacom Limited. The amended writ was served on Globacom Limited on the 7<sup>th</sup> day of May, 2015. This was again returned per a letter dated 1<sup>st</sup> June, 2015 by Glo Mobile.<o:p></o:p></span></p><p class="MsoNormal" style="margin-top:0cm;margin-right:-2.3pt;margin-bottom: 0cm;margin-left:0cm;margin-bottom:.0001pt;text-align:justify"><span lang="EN-GB" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-bidi-font-family:"Times New Roman"">Meanwhile, interlocutory judgement was entered against the 1<sup>st</sup> defendant on the 3<sup>rd</sup> day of June, 2015. On the 22<sup>nd</sup> day of June, 2015, counsel for the defendants filed a Notice of Appointment of Solicitor for the two defendants. The interlocutory judgement was, upon application, set aside on the 29<sup>th</sup> day of July, 2015. Thereafter, the Plaintiff obtained leave on the 11<sup>th</sup> day of August, 2015 to serve a Notice of writ and amended statement of claim on the defendants out of jurisdiction. <o:p></o:p></span></p><p class="MsoNormal" style="margin-top:0cm;margin-right:-2.3pt;margin-bottom: 0cm;margin-left:0cm;margin-bottom:.0001pt;text-align:justify"><span lang="EN-GB" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-bidi-font-family:"Times New Roman"">On the 10<sup>th</sup> day of September, 2015 the defendants filed a Notice of Entry of <br> Conditional Appearance. On the 13<sup>th</sup> day of October, 2015, the plaintiff filed a motion for judgement in default of defence.
