However, upon an application by the third to fifth defendants, the court granted them leave and they joined the action on the ground that their late father, one Nana Kwasi Afrane II alias Opanin Kwasi Oppong alias Kwasi Pong gifted two properties in contention, located at Dichemso in Kumasi, to them. They then joined the suit to defend their interests in the properties and also to avoid a multiplicity of suits.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0cm;margin-bottom:.0001pt;text-align: justify;line-height:115%"><span lang="EN-US" style="font-size:12.0pt;line-height: 115%;font-family:"Book Antiqua",serif;mso-bidi-font-family:"Times New Roman""><o:p> </o:p></span></p><p class="MsoNormal" style="margin-bottom:0cm;margin-bottom:.0001pt;text-align: justify;line-height:115%"><span lang="EN-US" style="font-size:12.0pt;line-height: 115%;font-family:"Book Antiqua",serif;mso-bidi-font-family:"Times New Roman"">It is also relevant to add that the original second and third plaintiffs passed away during the pendency of the suit and were substituted by the current second and third plaintiffs. They are described as No. 3 Block III and No. 13, Block 4. The plaintiffs contend that both properties belong to their family as they were put with the family resources but were in possession of Nana Kwasi Afrane II, alias Kwasi Oppong who passed away on 28<sup>th</sup> July, 1998. The defendants denied the assertion of the plaintiffs. He was a family of the plaintiffs but they described him in their statement of claim and in evidence as a <i>“nobody”</i>, a man of straw, worth nothing, a driver’s mate at Suhum, in short, a nonentity but became wealthy overnight and shot into prominence when he succeeded his uncle, Nana Afrane I of Bonwire. It is alleged Afrane I was a prosperous cocoa farmer because he cultivated it on a large scale, a licensed money lender and chief Kente weaver for the Asantehene; that he left a very large estate which was inherited by Afrane II when he succeeded him.<o:p></o:p></span></p><p cl
