The lease is in evidence as exhibit ‘C’. Photocopies of the allocation paper and site plan were also tendered in evidence as exhibits ‘A’ and ‘B’ respectively, subject to the condition that the originals of both documents would be produced later for the inspection of the court and the lawyer for the defendants. This was as a result of an objection by counsel for the defendants to the tendering of photocopies of the documents instead of the originals. However, in the course of the trial, the plaintiff failed and/or refused to produce the originals in terms of his undertaking with the Court.
