DECISION<o:p></o:p>

</div>This is an Application
for Review of the decision of the Commission dated 6th June, 2013 in favour of
the Respondent and confirmed the Complainant's dismissal. In the Application
for Review, the Complainant attacked the decision of the Commission on the
ground that the Commission overlooked the Complainant's evidence relating to
the fact that he was dismissed contrary to the rules of natural justice. <o:p></o:p>Before proceeding, the
Commission deems it fit and appropriate to chronicle in brief, the facts of the
case. The Applicant herein lodged a complaint of unlawful dismissal with the
National Labour Commission against the Respondent on 11" January, 2013. <o:p></o:p>The Complainant was
engaged by the Respondent on 1st October, 2005 as an Accounts Assistant and
posted to the Plastic &amp; Reconstructive Surgery Department. His appointment
letter was dated 15th September, 2005 and was
signed by Prof. Dr. Frimpong Boateng, the Chief
Administrator of the Hospital. <o:p></o:p>In a letter dated 2nd
January, 2013 and signed by the Chairman of the Respondent's Junior Staff
Disciplinary Committee, the Complainant was invited to appear before the
Committee on Friday 4" January, 2013 at 10.00
a.m. to assist the Committee in its investigations into “case of misdemeanor
leveled against him. The letter asked him to contact one Mr.
Samuel Quaye of the Pharmacy Department for direction to the venue. <o:p></o:p>The letter was left at
his Department and delivered to him by the Head of Department's Secretary on
4th January, 2013 together with a suspension letter dated 4th January, 2013
signed by Prof. Afua Hesse, Acting Chief Administrator of the Respondent
Hospital. <o:p></o:p><o:p>&nbsp;</o:p>The suspension letter stated that contrary to
the Respondent 's structures, policies and regulations he had been speaking to
the press making unsubstantiated allegations against senior officers and the
Board Chairman thereby bringing the Respondent 's name and its officers into disrepute. Consequently, he
had been suspended indefinitely without salary and the matter had been referred
to the Disciplinary Committee to look into. <o:p></o:p>The Ag. Chief
Administrator on the same 4th January, 2013, also addressed a letter to the
Chairman of the Junior Staff Disciplinary Committee referring the Complainant
to the Committee "to respond to a charge of gross insubordination in
organizing a press conference on 3rd January, 201
