When defendant/applicant defaulted in repayment of the facility despite repeated demands and warnings, the plaintiff/respondent sued him at the Commercial Division of the High Court. The writ of summons was served on defendant/applicant by substitution. Without filing an appearance, the defendant/applicant approached the plaintiff for settlement.<o:p></o:p></span></p><p class="MsoListParagraphCxSpLast" style="text-align:justify;text-indent:-31.5pt; mso-list:l0 level1 lfo1"><!--[if !supportLists]--><span style="font-size:12.0pt; line-height:115%;font-family:"Bookman Old Style","serif";mso-fareast-font-family: "Bookman Old Style";mso-bidi-font-family:"Bookman Old Style"">3.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: "Times New Roman";"> </span></span><!--[endif]--><span style="font-size:12.0pt;line-height:115%; font-family:"Book Antiqua","serif"">On 8<sup>th</sup> December 2011, the parties and their witnesses signed the Terms of Settlement. Incorporated in the Terms of Settlement is the Schedule of the payment by monthly installments of the indebtedness of the defendant/applicant starting from 31<sup>st</sup> January 2012 to 31<sup>st</sup> October 2014. The return date of the motion was 19<sup>th</sup> December, 2011. But the motion was heard and granted on 22<sup>nd</sup> December 2011 in the absence of the defendant/applicant herein and his counsel. On 19<sup>th</sup> January 2012, plaintiff/respondent caused an Entry of Consent Judgment to be issued and on 23<sup>rd</sup> January 2012 defendant/applicant paid the first installment of the debt according to the Terms of Settlement.
