Each of the 1<sup>st</sup>, 2<sup>nd</sup> accused persons and the appellant was sentenced to twenty-five (25) years on count one. In addition the appellant was also sentenced on the count of robbery to five (5) years imprisonment. His sentence was to run concurrently.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0in;margin-bottom:.0001pt;text-align: justify"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"; mso-fareast-font-family:Calibri;mso-bidi-font-family:"Times New Roman""><o:p> </o:p></span></p><p class="MsoNormal" style="margin-bottom:0in;margin-bottom:.0001pt;text-align: justify"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"; mso-fareast-font-family:Calibri;mso-bidi-font-family:"Times New Roman"">Briefly, the facts leading to the trial conviction and sentence of the appellant are as follows; On the 23<sup>rd</sup> of September 2012 at about 1.00 a.m., the complainant Mr. Gidzi together with his fiancée were aboard a Toyota Hilux Pick-up with registration number GW.4787Y and were returning to their home at the SSNIT Flat at Dome from a programme at the Banquet Hall of Parliament House, Accra. When they got to the entrance of their house, the complainant – Mr. Gidzi alighted from the vehicle to open the gate in order to drive in. Just at that point A1 – Emmanuel Adu-Gyamfi alias Medal and A2 Osei Emmanuel alias Emma with two others still at large all armed with pistols and cutlasses suddenly alighted from a saloon car which they had used to trail the complainants and threatened the complainants with their weapons and robbed them of their properties including the Toyota Hilux Pick-up vehicle, an i-pad, two i-phones, one blackberry phone and credit cards in the sum of Ghø400.00 The complainant reported the matter to the police who acting upon a tip-off went to the Neoplan Station in Accra and arrested the 1<sup>st</sup> and 2<sup>nd</sup> accused persons on board a Kumasi bound vehicle. A search conducted on them revealed the complainant’s i-pad. Upon interrogation A<sup>1</sup> and A<sup>2 </sup>admitted the offence and mentioned the appellant as an accomplice and led police to the house of the appellant but the appellant was not in the house. Subsequently, the police managed to trace and arrest the appellant who during interrogation admitted receiving the Toyota Hilux Pick-up with registration No. GW-4787-Y. Subsequently, the police managed to trace and arrest the appellant who during interrogation admitted receiving the Toyota Hilux Pick-up with registration No. GW-4787-Y and quickly drove the said vehicle together with the 4<sup>th</sup> accused to Lome, Togo to sell. The appellant led police to Togo where the 4<sup>th</sup> appellant was arrested and Mr. Gidzi’s stolen vehicle – Toyota Hilux Pick-up was also retrieved at a village called Adidogomo.
