In the affidavit supporting the application, Nii Jafro Mensah Larkai claimed to be the Head of the Onamrokor Adain family of Gbese, Accra. He claimed that as Head of the said family, he had power <b>“to execute instruments and other documents in transactions concerning the family’s lands and other properties and give valid discharges for monies paid to the family by any person or institution, government or otherwise”.</b><o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;tab-stops:2.0cm"><span lang="EN-GB" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-bidi-font-family:Arial">His complaint against the Executive Secretary of the Lands Commission Secretariat was that the Secretariat had refused to acknowledge him as the substantive head of the Onamrokor Adain family and had therefore neglected the documents executed by him for processing. A further complaint was that as a result of the failure of the Executive Secretary to accord him recognition as Head of the family, the Administrator of Stool Lands had been reluctant to release sums of money due to the family to him. He considered that without an order of mandamus issued by the High Court, the Executive Secretary would not accord him the recognition that he deserved. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;tab-stops:2.0cm"><span lang="EN-GB" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-bidi-font-family:Arial">Before the application for mandamus could be heard, Arthur Hammond Tetteh Quarcoo applied under Order 4, rule 5(2)(b) of the High Court Rules, CI 47, to be joined as an interested party, and the High Court made an order joining him as such. Nii Jafro Mensah Larkai however considers that the High Court was in error in joining Arthur Hammond Tetteh Quarcoo as an interested party and he has filed an appeal to this Court against the said order. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;tab-stops:2.0cm 451.3pt"><span lang="EN-GB" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-bidi-font-family:Arial">The Ruling in which the order of joinder was made is at page 46 to page 52 of the Appeal Record, and the Notice of Appeal is at page 54 to page 56 of the said Record. The Notice of Appeal discloses 4 grounds of objection to the Ruling of the High Court and it prays this Court to set aside the order of joinder made by the High Court and dismiss the application for joinder. It also seeks from this Court an order sending the application for mandamus back to the High Court to be heard by a different judge.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;tab-stops:2.0cm 451.3pt"><span lang="EN-GB" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-bidi-font-family:Arial">Nii Jafro Mensah Larkai is hereafter referred to as <b>“the Appellant”</b> and Arthur Hammond Tetteh Quarcoo is referred to as <b>“the Respondent”.<o:p></o:p></b></span></p><p class="MsoNormal" style="text-align:justify;tab-stops:2.0cm"><span lang="EN-GB" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-bidi-font-family:Arial">The Appellant’s grounds of objection read as follows:<o:p></o:p></span></p><p class="MsoNormal" style="margin-left:36.0pt;text-align:justify;tab-stops:2.0cm"><b><i><span lang="EN-GB" style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua",serif;mso-bidi-font-family:Arial">“(i) The learned judge erred in failing to gi
