Nana Mensah Bonsu, the Interested party/ respondent/respondent (hereinafter referred to as the Interested party) is the Kaasehene but whom the applicant described as a complete stranger or usurper who has been imposed on the Kaase people. The applicant therefore disputes his status as a chief and is determined to unseat him.<o:p></o:p></span></p><p class="MsoNormalCxSpMiddle" style="margin-top:12.0pt;mso-add-space:auto; text-align:justify;line-height:150%"><span lang="EN-US" style="font-size:12.0pt; line-height:150%;font-family:"Book Antiqua",serif"><o:p> </o:p></span></p><p class="MsoNormalCxSpMiddle" style="margin-top:12.0pt;mso-add-space:auto; text-align:justify;line-height:150%"><span lang="EN-US" style="font-size:12.0pt; line-height:150%;font-family:"Book Antiqua",serif">But the Kumasi Traditional Council (KTC), the respondent/respondent has not put in a place a Judicial Committee which is the body statutorily mandated to adjudicate on such matters or causes affecting chieftaincy. The applicant therefore filed an application for judicial review by way of mandamus compelling the respondent/respondent to establish a Judicial Committee and publicize its formation to try matters or causes affecting chieftaincy. The application is against the KTC, the respondent/respondent directly but indirectly affects the Interested party who is the target of applicant’s action ultimately.<o:p></o:p></span></p><p class="MsoNormalCxSpMiddle" style="margin-top:12.0pt;mso-add-space:auto; text-align:justify;line-height:150%"><span lang="EN-US" style="font-size:12.0pt; line-height:150%;font-family:"Book Antiqua",serif"><o:p> </o:p></span></p><p class="MsoNormalCxSpMiddle" style="margin-top:12.0pt;mso-add-space:auto; text-align:justify;line-height:150%"><span lang="EN-US" style="font-size:12.0pt; line-height:150%;font-family:"Book Antiqua",serif">However, the trial High Court dismissed the applicant’s application for Judicial Review. Aggrieved, the appellant appealed to this court. The processing of the appeal has gone very far with the parties filing their written submissions. But when this court admitted the applicant’s written submission which appeared to be filed out of time, the Interested party appealed against the exercise of this court’s discretion.<o:p></o:p></span></p><p class="MsoNormalCxSpMiddle" style="margin-top:12.0pt;mso-add-space:auto; text-align:justify;line-height:150%"><span lang="EN-US" style="font-size:12.0pt; line-height:150%;font-family:"Book Antiqua",serif"><o:p> </o:p></span></p><p class="MsoNormalCxSpMiddle" style="margin-top:12.0pt;mso-add-space:auto; text-align:justify;line-height:150%"><span lang="EN-US" style="font-size:12.0pt; line-height:150%;font-family:"Book Antiqua",serif">It would appear that it was the Interested party’s appeal which triggered this motion for an order for interlocutory injunction against him. For in paragraph 6 of the affidavit in support of this motion, the applicant averred that large sums of monies being accumulated royalties coming into the hands of the Interested party may never be recovered if the substantive appeal is delayed. So the prayers of the applicant in the motion are that the Interested party, his privies and servants be restrained from:<o:p></o:p></span></p><p class="MsoNormalCxSpMiddle" style="margin-top:12.0pt;margin-right:0cm; margin-bottom:10.0pt;margin-left:72.0pt;mso-add-space:auto;text-align:justify; text-indent:-36.0pt;line-height:150%"><span lang="EN-US" style="font-size:12.0pt; line-height:150%;font-family:"Book Antiqua",serif">“(1) Exercising in any manner whatsoever, any power of sale or leasing or otherwise disposing of any Kaase Stool land to any lessee, purchaser or other disponee, including, in particular, the Ghana Police Service and the Ghana National Fire Service;<o:p></o:p></span></p><p class="MsoNormalCxSpMiddle" style="margin-top:12.0pt;margin-right:0cm; margin-bottom:10.0pt;margin-left:72.0pt;mso-add-space:auto;text-align:justify; text-indent:-36.0pt;line-height:150%"><span lang="EN-US" style="font-size:12.0pt; line-height:150%;font-family:"Book Antiqua",serif"> (2) Permitting in any manner whatsoever the Ghana Police service and/or Ghana National Fire Service by any contractor, workman whatsoever, or personnel of either said service to enter or remain upon any such Kaase Stool Land for the purposes of any pursuant constructional work whatsoever, pending the hearing and determination of this pending appeal …”<o:p></o:p></span></p><p class="MsoNormalCxSpMiddle" style="margin-top:12.0pt;mso-add-space:auto; text-align:justify;line-height:150%"><span lang="EN-US" style="font-size:12.0pt; line-height:150%;font-family:"Book Antiqua",serif">In the affidavit in paragraph 5, the applicant averred that while the Interested party’s appeal is pending, he is engaging in prejudicial acts for which reason he must be restrained. One such act is that he has announced and cut the sot to give large trac
