Perpetual injunction restraining the defendant, privies, assigns servants and workmen from entering the said land.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span lang="EN-US" style="font-size:12.0pt;line-height:106%;font-family:"Book Antiqua",serif"> </span></p><p class="MsoNormal" style="text-align:justify"><span lang="EN-US" style="font-size:12.0pt;line-height:106%;font-family:"Book Antiqua",serif">CASE OF THE PLAINTIFF<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span lang="EN-US" style="font-size:12.0pt;line-height:106%;font-family:"Book Antiqua",serif">It is the case of the plaintiff that she acquired a parcel of land situate and lying at Sowutuom in the Ga Municipal Assembly in the Greater Accra Region which she registered in accordance with existing laws governing land registration in Ghana. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span lang="EN-US" style="font-size:12.0pt;line-height:106%;font-family:"Book Antiqua",serif">According to the plaintiff, she constructed 2 single rooms on the extreme ends of the land with a place of convenience and water reservoir and had since been in possession with another 2 bed rooms on the other extreme end of the land. It is the case of the plaintiff that 1st defendant destroyed her water reservoir and place of convenience and constructed a single room on the same land. The plaintiff submitted that that she has been in undisturbed possession until last year when the 1st defendant started to encroach and trespass on the land. According to the plaintiff she reported the matter of trespass to the Police Property and Fraud Unit which investigated the matter and 1st defendant was called upon to produce his title and proof of ownership but he could not produce anything to that effect and the police warned him to desist from the act. It is the case of the plaintiff that, 1st defendant did not heed to any advice to stop development on the land. She therefore prayed this court for the above stated reliefs<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span lang="EN-US" style="font-size:12.0pt;line-height:106%;font-family:"Book Antiqua",serif"> </span></p><p class="MsoNormal" style="text-align:justify"><b><span lang="EN-US" style="font-size:12.0pt;line-height:106%;font-family: "Book Antiqua",serif">CASE OF THE DEFENDANT<o:p></o:p></span></b></p><p class="MsoNormal" style="text-align:justify"><span lang="EN-US" style="font-size:12.0pt;line-height:106%;font-family:"Book Antiqua",serif">The 1st and 2nd defendants submitted that the parcel of land situated and lying at Sowutuom in the Ga South Municipal Assembly is registered in the name Messrs.’ Fred Brown and Henry Quartey Papafio with registration number AR4102A/2004 acquired on the 10th April 1997 from Colonel John Tetteh Addy of the Abola Piam family. It is the case of the 1st and 2nd defendants that the 2 single rooms constructed by the plaintiff are on a different spot. The 1st defendant stated that he was to provide service for one Madam Ama Odwira Danquah by constructing a single room because the defendant owns a document on the land. The 1st and 2nd defendants submitted that they were put on the land by one Madam Ama Odwira Danquah who is the bonafide owner of the land which was registered by her assignor with registration number AR 4102A/2004 at Land Commission. According to the 1st and 2nd defendants, the owner of the land, Madam Ama Odwira Danquah purchased the land from Messrs.’ Fred Brown and Henry Quartey Papafio. It is the defendant’s case that the plaintiff never checked from the Lands Commission before she registered her land at the Land Title Registry.
