mso-bidi-font-family:"Book Antiqua"">RULING<o:p></o:p></span></b></p> </div><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua",serif">This is an application on notice by the Plaintiff/Applicant (Applicant) for an Order of Interlocutory Injunction to issue against the Defendants/Respondents (Respondents) trading in the name and style of ANSUN TRADING ENTERPRISE AND APPEB TRADING ENTERPRISE whether by themselves, their officers, servants or agents or any of them to restrain them from marketing, distributing, selling or offering for sale, supplying or offering to supply the insect repellant/air freshner that the Defendant has manufactured using the Plaintiff’s industrial design No. AP/D//00149 and imported into Ghana.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua",serif"> </span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua",serif">The Applicant also prayed the court to order the Defendants whether by themselves or by their officers, servants or agents or any of them to deliver up inot the custody of such person as this court may specify, all the cartons of insect repellant/air refreshner the Defendant has manufactured using the Plaintiff’s industrial design. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua",serif"> </span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua",serif">The Respondents have opposed the application stating that they had since they had been advised by Counsel, they had ceased to market, distribute or sell the air refreshner/insect repellant. There was also an issue about the number of cartons imported.
