I do not think there is any merit in the application.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua","serif";mso-bidi-font-family:Arial">In an earlier application filed on the 25<sup>th</sup> April, 2016 the court refused the prayer of the 2<sup>nd</sup> defendant praying for leave to reinstate the defence of the 2<sup>nd</sup> defendant and to file a witness statement. It is the same application that the 2<sup>nd</sup> defendant has filed and moved today. To recall the history of the case, the parties were ordered to file their respective witness statement on the 24<sup>th</sup> February, 2016. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua","serif";mso-bidi-font-family:Arial">The defendants failed to comply with the order of the court. The court accordingly struck out the statement of the defence of the defendant in accordance with C.I 87.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua","serif";mso-bidi-font-family:Arial">The plaintiff led evidence on the 18<sup>th</sup> April, 2016 and the case was adjourned for judgment. On the date of judgment counsel for 2<sup>nd</sup> defendant moved the court and persuaded the court to allow him cross-examine the plaintiff before judgment was pronounced. The court granted the prayer of 2<sup>nd</sup> defendant and counsel started his cross-exams. Having conducted extensive cross-examination, counsel is now praying the court to set aside the proceedings and go back to case management by granting them leave to file their witness statement and reinstate of their defence.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua","serif";mso-bidi-font-family:Arial">In my view, I do not think this discretion even if the court has, should be exercised in the present circumstance. This is not an issue of technicalities. The fact is that the rules of court were enacted for their compliance and parties who come before the court should be made to understand that the rules and orders of the court cannot be disregarded with impunity.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua","serif";mso-bidi-font-family:Arial">In my view it is too late in the day for the court to go back to case management having regard to the circumstances.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua","serif";mso-bidi-font-family:Arial">I refuse the application.
