Both parties agree that the Plaintiff’s Company, Forestry Enterprises Limited, formally Forestry Enterprise, was a customer of the Defendant Bank. It is also uncontroverted that the Former Managing Director of the Plaintiff’s Company, that is his father, Albert Enti, contracted a loan from the Defendant bank which was subsequently discharged. It is also not in issue that the loan was secured with property with Land Registry No. A 2891/1978. <o:p></o:p></span></p><p class="MsoNormal" style="margin-top:14.6pt;text-align:justify;mso-pagination: none;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt;mso-border-shadow: yes"><span lang="EN-US" style="font-size: 12pt; line-height: 115%; font-family: "Book Antiqua", serif;">The parties part ways on the issue of whether or not it was the original document on the property which was deposited with the defendant Bank or a photocopy. <o:p></o:p></span></p><p class="MsoNormal" style="margin-top:14.6pt;text-align:justify;mso-pagination: none;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt;mso-border-shadow: yes"><span lang="EN-US" style="font-size: 12pt; line-height: 115%; font-family: "Book Antiqua", serif;">It is the case of the Plaintiff that when the loan was being contracted by his late father, it was first required that he surrender original copies of documents of business registration documents, for a current account to be opened for him. He also says that when his late father obtained the mortgage facility which has given rise to this action, same was secured with <o:p></o:p></span></p><p class="MsoNormal" style="margin-top:14.6pt;margin-right:0cm;margin-bottom: 0cm;margin-left:18.0pt;margin-bottom:.0001pt;text-align:justify;mso-pagination: none;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt;mso-border-shadow: yes"><span lang="EN-US" style="font-size: 12pt; line-height: 115%; font-family: "Book Antiqua", serif;">a) An original indenture dated 21<sup>st </sup>February, 1978 between C.F.C.
