His employment was regulated by a contract of employment dated 27<sup>th</sup> July, 2012. This relationship was abruptly terminated by the defendant on grounds of incompetence. line-height:115%;font-family:"Book Antiqua",serif">From the onset, I would note that this case was transferred to the Commercial Court by Her Ladyship, the Chief Justice, from the Industrial and Labour Court on 17<sup>th</sup> November, 2015.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;tab-stops:170.4pt"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif">I have reviewed the record of proceedings and the evidence adduced in this case extensively. Plaintiff’s case consisted of his own testimony, that of the other two (2) witnesses who testified on his behalf and the documentary evidence he submitted in support of his claim, marked in the record as Exhibits ’A’ through ‘P’. On the other hand, the defendant’s case was limited to the cross-examination of the plaintiff, the testimony of its witness and its supporting documents marked into evidence as Exhibits ‘1’ through ‘5’. I have given my thoughtful consideration to the rival contentions put forward by the parties to the suit as well as the written submissions filed by both Counsel on their behalf. I have also considered the relevant provisions of the High Court (Civil Procedure) Rules, 2004 (C.I 47), the Labour Act, 2003, Act 651 (hereinafter, “Labour Act”), and the case law on this matter.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua",serif">The case of the plaintiff is that sometime in July 2012, he was employed by the defendant company as a Project Engineer earning a gross monthly salary of the cedi equivalent of
