</div>INTRODUCTION<o:p></o:p><o:p>&nbsp;</o:p>On 27th November, 2013 one Ebenezer Ayisi filed a
complaint at the National Labour Commission that he had been assaulted by his
immediate Supervisor and wrongfully dismissed in violation of the Labour Act,
2003 (Act 651).<o:p></o:p><o:p>&nbsp;</o:p>THE CASE OF THE
COMPLAINANT<o:p></o:p><o:p>&nbsp;</o:p>According to Ebenezer Ayisi, the Complainant
herein, he was employed by Ghana Aluminum Products Limited, the Respondent
herein, in 2008 and worked until 2013 without Social Security and remained a
Casual Worker all this while. It was his case that one Mr. Lartey his immediate
Supervisor assaulted him on 5th June, 2013. He claimed that he sustained
injuries as a result of the assault, where upon he reported to management. He
was given a medical form to go to the hospital. He further claimed that on his
return to the factory the Security prevented him from entering. Therefore he
was sacked. He is therefore claiming compensation of twenty-five thousand Ghana
Cedis from the company. He made a statutory declaration dated the 20th day of
May, 2014 that he was an employee of the Respondent Company.<o:p></o:p><o:p>&nbsp;</o:p>THE CASE OF THE
RESPONDENT<o:p></o:p><o:p>&nbsp;</o:p><p class="MsoNormal" style="margin-bottom:0cm;margin-bottom:.0001pt;text-align:

mso-border-shadow:yes">In an Affidavit in Opposition dated 13th March 2015
sworn to one Krishnasamy Balaji who deposed that he was the Operation Manager
of the Respondent claimed that Ebenezer Ayisi never worked continuously with
the company for four years. He claimed in the said affidavit that Ebenezer
Ayisi worked on various occasions with the Respondent as a Cleaner on piece
rated basis.<o:p></o:p><p class="MsoNormal" style="margin-bottom:0cm;margin-bottom:.0001pt;text-align:
justify;text-indent:2.15pt;line-height:normal;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt;
mso-border-shadow:yes"><o:p>&nbsp;</o:p>He further claimed that Ebenezer Ayisi worked
whenever there was a job available for him to do and got paid upon completion
of that job.<o:p></o:p><o:p>&nbsp;</o:p>The Deponent further deposed that Ebenezer Ayisi
was not under any obligation to report for work regularly during the company's
working hours but worked as and when there was a job and the company paid him
various amounts depending on the jobs he did.<o:p></o:p><o:p>&nbsp;</o:p><p class="MsoNormal" style="margin-bottom:0cm;margin-bottom:.0001pt;text-align:
