DECISION<o:p></o:p>

</div>Introduction <o:p></o:p>On 16th October,
2013, Mr. Anthony Kwame Can-Tamakloe (hereinafter
referred to as Complainant) filed a complaint
with the National Labour Commission (NLC) to the effect that his employment
with Pergah Transport Limited (hereinafter referred to as Respondent), was terminated as a result of a stated ongoing
restructuring exercise but he was denied the payment of severance award as
stipulated by Act 651. <o:p></o:p>On 17th October, 2013, the NLC referred the complaint to the Respondent with a request for its response. <o:p></o:p>On 28th October, 2013,
the Respondent sent its written response to the NLC and stated that
the employment of the Complainant was terminated as a result of an ongoing
restructuring exercise and that the Complainant was given due notice. <o:p></o:p>The NLC attempted to
resolve the matter amicably through facilitation but this
attempt was not successful and the matter was subsequently sent to the full Commission to adjudicate upon. <o:p></o:p>The Commission therefore decided to settle the matter through summary settlement, pursuant to Regulation 33 (1) of the National
Labour Commission Regulations, 2006, LI 1822and on 1st August, 2014 the NLC sent a letter to the parties and directed as follows: <o:p></o:p><p class="MsoListParagraphCxSpFirst" style="margin-top:9.1pt;mso-add-space:auto;

Complainant was required to submit his statement of claim by sworn
affidavit to the Commission by 13th August, 2014 and serve a copy on the
