</div>Brief Facts <o:p></o:p>By a letter dated 18
March 2013, the Complainants herein lodged a complaint against their former
employer for using various figures outside the Collective Agreement to
calculate their end of service benefits. They sought the following reliefs: <o:p></o:p><p class="MsoNormal" style="margin-top:12.0pt;margin-right:0cm;margin-bottom:

yes">b. To use the correct
figure, that is their last salary at the point of exist. <o:p></o:p>Complainants' case <o:p></o:p>The gravamen of
their complaint was that between 2010 and 2012 when they attained the
compulsory retirement age of 60 years respectively, they were entitled to
retirement benefits by their contract of employment. This, they claimed was
communicated to them by their employer, TV3 Limited. However, according to them
the employer wrote to them that the benefit which accrued to them included only
the period they served as Junior Staff and ignored the period they served as
Management Staff. <o:p></o:p>The Complainants
emphasised the fact that the Respondent also based the calculation of their end
of service benefits on their salaries as junior staff though at the time of
their retirements they had all been promoted to Management Staff. <o:p></o:p>The Complainant averred that when they petitioned the
National Labour Commission, they were invited by one Mr. Ato Sarpong to the
offices of the Respondent company who informed them that he had been asked by
the Commission to mediate the matter. <o:p></o:p>They claimed that in furtherance of Mr. Ato Sarpong's intervention he (Ato Sarpong) proposed a 13% increase of the disputed amount to be paid as first instalment to the Complainants assuring them
that the calculation based on the formula proposed by the Complainants would be adopted to arrive at the correct retirement benef
