The said contract was for the construction of Ashiaman town roads. It is the case of the plaintiff that he negotiated a financial deal with a financier who agreed to advance the sum, the cedi equivalent of UD$50,000 to 1<sup>st</sup> defendant on condition that he shall be the guarantor of the same. According to the plaintiff, as a condition for accessing the amount, the 1<sup>st</sup> defendant agreed to pay all amount to be paid by the 2<sup>nd</sup> defendant for the execution of the contract into its GCB Bank, Kaneshie Branch Account Number 111113001456 and to change the account signature mandate to make him an additional signatory to the said account.
