No. 151 Block 17 section 168, Haatso in the Greater Accra Region of Accra was put up for sale at Ghana Home Loans at a price of $270,000 when the defendant approached him and expressed interest in the unexpired term of his lease in the property, House. No. 151 Block 17 section 168, Haatso which has been assigned to plaintiff. Plaintiff stated that the defendant inspected House. No 151 Block 17 section 168, Haatso at a time he the plaintiff occupied the house with his wife and child. Defendant satisfied with the state of the property expressed the desire to acquire plaintiff’s unexpired interest at a price of $220,000.00. It is the case of the plaintiff that there was the understanding that until the payment of $200,000 deposit is paid to the plaintiff there will be no agreement to assign plaintiff’s interest to the defendant. Accordingly the defendant deposited an amount of<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0cm;margin-bottom:.0001pt;text-align: justify"><span lang="EN-US" style="font-size:12.0pt;mso-bidi-font-size:11.0pt; line-height:106%;font-family:"Book Antiqua",serif">$130,000 in or about August 25, 2014 to plaintiff as deposit in an attempt to fulfill his obligation under the said oral agreement.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0cm;margin-bottom:.0001pt;text-align: justify"><span lang="EN-US" style="font-size:12.0pt;mso-bidi-font-size:11.0pt; line-height:106%;font-family:"Book Antiqua",serif"> </span></p><p class="MsoNormal" style="margin-bottom:0cm;margin-bottom:.0001pt;text-align: justify"><span lang="EN-US" style="font-size:12.0pt;mso-bidi-font-size:11.0pt; line-height:106%;font-family:"Book Antiqua",serif">The defendant was permitted to go into possession only two weeks after plaintiff and his family had relocated to a new residence. It is the case of the plaintiff that after the defendant has taken possession of the property, the defendant has refused to honor his obligation under their oral agreement and the defendant had tampered with fixtures and fittings causing damage to parts of the property without express authority of the plaintiff. The plaintiff stated that the defendant has no intention of honoring his obligation under the agreement above and will also not yield vacant possession of the property to plaintiff unless ordered by this court to do so.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0cm;margin-bottom:.0001pt;text-align: justify"><span lang="EN-US" style="font-size:12.0pt;mso-bidi-font-size:11.0pt; line-height:106%;font-family:"Book Antiqua",serif">Plaintiff stated further that the property has been placed on the market to assign his interest to willing and able assignees to enable plaintiff refund to the defendant $130,000 paid by the defendant. The defendant’s present occupation of the property however has made it impossible for plaintiff to allow ready, willing and able buyers to view and pay the full price to plaintiff.
