The plaintiff made part payment for the vehicle and gave six monthly post-dated cheques to the tune of US$2,383.00 each for the remainder of the purchase price. In pursuance of the sale, the parties entered into a Credit Sale Agreement (Exhibit A) under which the vehicle was registered in the name of the defendant company, insured in the name of the plaintiff but with the benefit of the insurance going to the defendant company and ownership retained in the defendant company until the fulfilment of all financial obligations by the plaintiff to the defendant company. The defendant handed over the vehicle to the plaintiff on 6<sup>th</sup> July 2011.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0cm;text-align:justify;line-height: 150%"><span style="font-size:12.0pt;line-height:150%;font-family:"Book Antiqua",serif; mso-bidi-font-family:"Times New Roman""> </span></p><p class="MsoNormal" style="margin-bottom:0cm;text-align:justify;line-height: 150%"><span style="font-size:12.0pt;line-height:150%;font-family:"Book Antiqua",serif; mso-bidi-font-family:"Times New Roman"">On 15<sup>th</sup> October 2011, the vehicle, whilst being driven by the plaintiff, had an accident and the plaintiff submitted it for repairs to be done which repairs were completed on 20<sup>th</sup> October 2011. The plaintiff was however not satisfied with the nature of the repairs and in agreement with the defendant, the plaintiff left the vehicle for the defendant to correct the issues she had identified with the repairs. <o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0cm;text-align:justify;line-height: 150%"><span style="font-size:12.0pt;line-height:150%;font-family:"Book Antiqua",serif; mso-bidi-font-family:"Times New Roman""> </span></p><p class="MsoNormal" style="margin-bottom:0cm;text-align:justify;line-height: 150%"><span style="font-size:12.0pt;line-height:150%;font-family:"Book Antiqua",serif; mso-bidi-font-family:"Times New Roman"">Per the pleadings and the evidence on record, the said repairs were completed on 25<sup>th</sup> October 2011 but the plaintiff agreed to pick up the vehicle on the next day. Whilst the defendant asserts that they called the plaintiff to pick up the vehicle on 25<sup>th</sup> October 2011 but she claimed that because of traffic she would come the next day, the plaintiff asserts that at the time the defendant called her to come for the vehicle, it was too late and there was no way she could have gotten to the defendant’s premises before their closing time. They all thus agreed that she should pick up the vehicle the next day.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0cm;text-align:justify;line-height: 150%"><span style="font-size:12.0pt;line-height:150%;font-family:"Book Antiqua",serif; mso-bidi-font-family:"Times New Roman""> </span></p><p class="MsoNormal" style="margin-bottom:0cm;text-align:justify;line-height: 150%"><span style="font-size:12.0pt;line-height:150%;font-family:"Book Antiqua",serif; mso-bidi-font-family:"Times New Roman"">Unfortunately for the parties, there was a severe downpour on the night of 25<sup>th</sup> October 2011 into the early morning hours of 26<sup>th</sup> October 2011 which led to severe flooding in most parts of Accra. The flooding affected the defendant’s premises and vehicles parked on the premises including the vehicle in contention in this suit. The plaintiff could thus not pick up the vehicle as agreed between the parties.
