She was given the old type indenture in 2004 but she later requested for the pamphlet type indenture which was given to her on 14<sup>th</sup> March 2011. The plaintiff asserts that she commenced work on the land but the 2<sup>nd</sup> defendant and his brothers came onto the land to stop her workers from continuing with the work claiming that it was their father who was farming on the land and as such they should pay compensation to him. <o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0cm;text-align:justify;line-height: 150%"><span lang="EN-US" style="font-size:12.0pt;line-height:150%;font-family: "Book Antiqua",serif;mso-bidi-font-family:"Times New Roman";mso-ansi-language: EN-US"> </span></p><p class="MsoNormal" style="margin-bottom:0cm;text-align:justify;line-height: 150%"><span lang="EN-US" style="font-size:12.0pt;line-height:150%;font-family: "Book Antiqua",serif;mso-bidi-font-family:"Times New Roman";mso-ansi-language: EN-US">The plaintiff brought this development to the notice of their grantor who confirmed the fact that the 2<sup>nd</sup> defendant’s father Joe Marnah used to farm on the land and as such they should compensate him. The plaintiff asserts that she duly paid Joe Marnah an amount of GH</span><span lang="EN-US" style="font-size:12.0pt; line-height:150%;font-family:"Times New Roman",serif;mso-ansi-language:EN-US">₵</span><span lang="EN-US" style="font-size:12.0pt;line-height:150%;font-family:"Book Antiqua",serif; mso-bidi-font-family:"Times New Roman";mso-ansi-language:EN-US">600.00 as compensation for which she was issued with a receipt. She then started constructing a fence wall around the land but the defendants destroyed the foundation and asked her workers to stop working on the land.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0cm;text-align:justify;line-height: 150%"><span lang="EN-US" style="font-size:12.0pt;line-height:150%;font-family: "Book Antiqua",serif;mso-bidi-font-family:"Times New Roman";mso-ansi-language: EN-US"> </span></p><p class="MsoNormal" style="margin-bottom:0cm;text-align:justify;line-height: 150%"><span lang="EN-US" style="font-size:12.0pt;line-height:150%;font-family: "Book Antiqua",serif;mso-bidi-font-family:"Times New Roman";mso-ansi-language: EN-US">It is the plaintiff’s case that the defendant’s attempt at preventing her workers from working on the land resulted in a confrontation which one Nene Djabi attempted to arbitrate but the defendants did not make themselves available for settlement. Nene Djabi, out of frustration, eventually abandoned the attempt. It is further the plaintiff’s case that the 2<sup>nd</sup> defendant promised to give the plaintiff another land far away from the land in dispute but plaintiff refused the offer. <o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0cm;text-align:justify;line-height: 150%"><span lang="EN-US" style="font-size:12.0pt;line-height:150%;font-family: "Book Antiqua",serif;mso-bidi-font-family:"Times New Roman";mso-ansi-language: EN-US"> </span></p><p class="MsoNormal" style="margin-bottom:0cm;text-align:justify;line-height: 150%"><span lang="EN-US" style="font-size:12.0pt;line-height:150%;font-family: "Book Antiqua",serif;mso-bidi-font-family:"Times New Roman";mso-ansi-language: EN-US">This eventually led to the 1<sup>st</sup> defendant using a bulldozer to destroy the plaintiff’s fence wall and footing on the land and also levelling the plaintiff’s trip of sand and stones on the land. The plaintiff asserts that the defendants eventually brought sand and stone onto the land and started digging a trench to construct a fence wall on the land. The plaintiff states that if the defendants are not restrained, they will eventually take over the land from the plaintiff.
