There is unimpeachable evidence that the Plaintiff/Respondent was served with this application on the 19<sup>th</sup> of May, 2017. Yet when the due date of 29/05/17 came for the application to be moved the Plaintiff and his counsel were absent from court without any cause. The court had no good ground to adjourn the hearing of the application and accordingly allowed the Defendant/Applicant to move the application. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%;tab-stops:172.5pt"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"; mso-ansi-language:EN-US"><o:p> </o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%;tab-stops:172.5pt"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"; mso-ansi-language:EN-US">According to the applicant the Plaintiff/Respondent is seeking to re-litigate a matter that has been fully and effectively determined by the court, Coram: Afia Serwaah Asare-Botwe J. wherein Plaintiff had judgment in his favour.
