border:none;mso-border-bottom-alt:solid windowtext 1.5pt;padding:0in; mso-padding-alt:0in 0in 1.0pt 0in"><b><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">RULING<o:p></o:p></span></b></p> </div><p class="MsoNormal" style="text-align:justify;line-height:115%"><span lang="EN-GB" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif""><o:p> </o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span lang="EN-GB" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">In this application, counsel for Defendant seeks to set aside the execution process set in motion by the Plaintiff/Judgment Creditor/Respondent and for the release of the Defendant/Judgment Debtor’s vehicle with registration number GR 5452 L.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span lang="EN-GB" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">In moving the application, counsel relied on the affidavit in support and the search report exhibited to the application which shows that the Plaintiff/Judgment Creditor did not seek leave of this court before going into execution.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span lang="EN-GB" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">Counsel submitted that to the extent that no leave was sought, the execution process must be set aside.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span lang="EN-GB" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">The Plaintiff/Judgment Creditor caused an affidavit in opposition to be field on his behalf. It was deposed therein that after service of entry of the judgment in default of appearance on the Defendant, the Plaintiff filed a Writ of Fieri Facias on 01/08/2017 which kick started the execution has been brought in bad faith. Per the court’s records, the entry of judgment was duly served on the Defendant/Judgment Debtor on 30/05/2017 by Lawrence Afayori, a bailiff attached to the court. (See his affidavit of service dated 13/06/2017.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span lang="EN-GB" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">It has not been denied that the default judgment was entered against the Defendant on 12/01/2017 which is approximately ten (10) months ago. The question to be asked is whether the judgment creditor required leave of the court to be able to go into execution.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span lang="EN-GB" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">It is provided under order 44 rule 3 (1) of the High Court (Civil procedure) Rules, 2004, C.I. 47 that:<o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;text-indent:-.5in; line-height:115%"><span lang="EN-GB" style="font-size:12.0pt;line-height:115%; font-family:"Book Antiqua","serif"">(c) A writ of execution to enforce a judgment or order may not issue without leave of the court in the following cases.<o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;text-indent:-.5in; line-height:115%"><span lang="EN-GB" style="font-size:12.0pt;line-height:115%; font-family:"Book Antiqua","serif"">(a) Where six years or more have elapsed since the date of the judgment or order.<o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;text-indent:-.5in; line-height:115%"><span lang="EN-GB" style="font-size:12.0pt;line-height:115%; font-family:"Book Antiqua","serif"">(b) Where any change has taken place, whether by death or otherwise, in the parties entitled or liable to execution under the judgment or order.<o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;text-indent:-.5in; line-height:115%"><span lang="EN-GB" style="font-size:12.0pt;line-height:115%; font-family:"Book Antiqua","serif"">(c) Where the judgment or order is against the assets of a deceased person coming into the hands of his or her executors or administrators after the date of the judgment or order, and it is sought to issue execution against assets.<o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;text-indent:-.5in; line-height:115%"><span lang="EN-GB" style="font-size:12.0pt;line-height:115%; font-family:"Book Antiqua","serif"">(d) Where under the judgment or order, any person is entitled to relief subject to the fulfilment of any condition which it is alleged has been fulfilled.<o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;text-indent:-.5in; line-height:115%"><span lang="EN-GB" style="font-size:12.0pt;line-height:115%; font-family:"Book Antiqua","serif"">(e) Where any goods to be seized under a writ of execution are in the hands of a receiver appointed by the court or a sequestrator.<o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span lang="EN-GB" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">Upon a careful examination of the deposition made in respect of the instant application and after listening to the brief submission of counsel for the Defendant/Judgment Debtor/Applicant, I am of the view that this case does not fall within the situations where leave of the court is required before a party can go execution.<o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span lang="EN-GB" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">The Defendant/Judgment Debtor has not demonstrated to this court in any other satisfactory manner why the execution process is to be set aside. The Plaintiff/Judgment Creditor followed the due process in executing the judgment obtained from this court in January 12, 2017.<o:p></o:p></span></p><p class="MsoNormal" style=
