According to the Plaintiff the Defendant agreed to hand over the property to her in two months but four years after the house is still not delivered. The Defendant says after receiving the purchase price it encountered problems including encroachment on a large tract of its land earmarked for the construction and it duly informed the Plaintiff. The issues for my resolution in this case are: whether the Plaintiff entered into the purchase agreement with the Defendant, whether the Plaintiff is entitled to the relief of specific performance and whether the Plaintiff is entitled to recover costs of rent incurred because the Defendant failed to deliver the house on time.

<span lang="EN-CA" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"; mso-fareast-font-family:"Times New Roman";mso-bidi-font-family:"Times New Roman"; mso-fareast-language:EN-CA">

<span lang="EN-CA" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"; mso-fareast-font-family:"Times New Roman";mso-bidi-font-family:"Times New Roman"; mso-fareast-language:EN-CA">[2]<span lang="EN-CA" style="font-size: 12.0pt;line-height:115%;font-family:"Book Antiqua","serif";mso-fareast-font-family: "Times New Roman";mso-bidi-font-family:"Times New Roman";mso-fareast-language: EN-CA"> Having failed to deliver the house further to the agreement reached the Plaintiff issued out a Writ of Summons from the registry of this Court for the following reliefs:

<span lang="EN-CA" style="font-size:12.0pt;line-height:115%;font-family: "Book Antiqua","serif";mso-bidi-font-family:"Times New Roman"">

<span lang="EN-CA" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"; mso-fareast-font-family:"Times New Roman";mso-bidi-font-family:"Times New Roman"; mso-fareast-language:EN-CA">“(1) An order of specific performance to compel the defendant to perform its part of the agreement to provide the Plaintiff with a 2 bedroom executive house; OR.

<span lang="EN-CA" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"; mso-fareast-font-family:"Times New Roman";mso-bidi-font-family:"Times New Roman"; mso-fareast-language:EN-CA">(2) Alternatively to pay the Plaintiff the replacement value or cost of a 2 bedroom executive house as at the time of judgment or payment.

<span lang="EN-CA" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"; mso-fareast-font-family:"Times New Roman";mso-bidi-font-family:"Times New Roman"; mso-fareast-language:EN-CA">(3) Damages for breach of contract

<span lang="EN-CA" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"; mso-fareast-font-family:"Times New Roman";mso-bidi-font-family:"Times New Roman"; mso-fareast-language:EN-CA">(4) Costs”.

<span lang="EN-CA" style="font-size:12.0pt;line-heig
