Subsequently, the parties were, on the 30<sup>th</sup> day of March 2017, ordered to file their witness statements. The Plaintiff was to file its witness statement first, serve it on the defendant, who was also to file its witness statement within two weeks from the date of service of the Plaintiff’s witness statement. The case was adjourned to 28<sup>th</sup> April 2017.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua","serif";mso-fareast-font-family: Arial;mso-bidi-font-family:Arial">On the 17<sup>th</sup> day of May 2017, the Plaintiff’s witness statement was served on the Defendant as shown by the affidavit of service filed by the court process server. On the 28<sup>th</sup> April 2017, the Defendant failed to show up in court and neither did it file the witness statement as ordered by the court. The case was therefore adjourned to 2<sup>nd</sup> June 2017. When the case was called on the 2<sup>nd</sup> June 2017, the Defendant again failed to attend court, hence, hearing notice was ordered to be served on the Defendant to be present in court on the 15<sup>th</sup> June 2017. However, despite the service of the said hearing notice on the Defendant, it still failed to attend court on the 15<sup>th</sup> June 2017. The court, therefore, dismissed the statement of defence filed by the Defendant on the strength of rule 7A sub rule 3 (b) of Order 32 of the High Court (Civil Procedure) (Amendment) Rules, 2014 CI 87. which states that:<o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"; mso-fareast-font-family:Arial;mso-bidi-font-family:Arial">“(3) Where a party has failed to comply with any of the directions given at a case management conference or a pretrial review or both, the Judge may make any of the following orders: <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"; mso-fareast-font-family:Arial;mso-bidi-font-family:Arial">(b) strike out the defence and counterclaim as the case may be, if the non complying party is a Defendant.” <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua","serif";mso-fareast-font-family: Arial;mso-bidi-font-family:Arial">The matter was eventually fixed for hearing to the 29<sup>th</sup> June 2017 with an order for a hearing notice to be served on the Defendant. On the 29<sup>th</sup> June 2017, the case was called; as usual, the Defendant and its solicitor were absent.
