I reserved my reasons, which I now proceed to give. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua","serif";mso-bidi-font-family:Arial">On the 21<sup>st</sup> February, 2017 the Applicant purchased property numbered 28, Airport Hills, Martey Tsuru, Accra, at a public Auction conducted on the orders of the Court. The applicant duly paid for the property sold. A certificate of purchase was accordingly issued to the applicant. The applicant, subsequently filed the present application to evict the respondents from the property he purchased at the auction. The respondents resist the application on the grounds that:<o:p></o:p></span></p><p class="MsoListParagraphCxSpFirst" style="margin-left:1.25in;mso-add-space: auto;text-align:justify;text-indent:-.25in;mso-list:l1 level1 lfo1"><!--[if !supportLists]--><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"; mso-fareast-font-family:"Book Antiqua";mso-bidi-font-family:"Book Antiqua"">1.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: "Times New Roman";"> </span></span><!--[endif]--><span style="font-size:12.0pt;line-height:115%; font-family:"Book Antiqua","serif";mso-bidi-font-family:Arial">The application is incompetent; and <o:p></o:p></span></p><p class="MsoListParagraphCxSpLast" style="margin-left:1.25in;mso-add-space:auto; text-align:justify;text-indent:-.25in;mso-list:l1 level1 lfo1"><!--[if !supportLists]--><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"; mso-fareast-font-family:"Book Antiqua";mso-bidi-font-family:"Book Antiqua"">2.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: "Times New Roman";"> </span></span><!--[endif]--><span style="font-size:12.0pt;line-height:115%; font-family:"Book Antiqua","serif";mso-bidi-font-family:Arial">That premised upon fraud (primarily perpetrated post the auction sale) which vitiates all and was brought to the notice of the defendants/respondents only after the motion for eviction had been filed on the 24<sup>th</sup> day of October, 2017.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua","serif";mso-bidi-font-family:Arial">I have read the application and the affidavits filed by the parties. I have also read the written submissions filed by both counsel. Thoughtful consideration has been given to order 45 of CI 47 and the principles governing the setting aside of auction sales. It is however useful to state the provisions of order 45 rules 10, 11 and 12(3) of CI 47, which are that:<o:p></o:p></span></p><p class="MsoNormal" style="margin-left:1.0in;text-align:justify"><i><span style="font-size:12.0pt;line-height: 115%;font-family:"Book Antiqua","serif";mso-bidi-font-family:Arial">“10. (1) At any time within twenty-one days from the date of the sale of any immovable property, an application may be made to the court to set aside the sale on the ground of any irregularity in the conduct of the sale, but no sale shall be set aside on the ground of such irregularity unless the applicant proves to the satisfaction of the court that he has sustained injury by reason of the irregularity. <o:p></o:p></span></i></p><p class="MsoNormal" style="margin-left:1.0in;text-align:justify"><i><span style="font-size:12.0pt;line-height: 115%;font-family:"Book Antiqua","serif";mso-bidi-font-family:Arial">(2) If the application is granted by the court, the court shall make an order setting aside the sale for irregularity, and thereupon the purchaser shall be entitled to receive back any money deposited or paid by the purchaser on account of the sale, with or without interest, to be paid by such parties and in such manner as the court may direct. <o:p></o:p></span></i></p><p class="MsoNormal" style="margin-left:1.5in;text-align:justify"><i><span style="font-size:12.0pt;line-height: 115%;font-family:"Book Antiqua","serif";mso-bidi-font-family:Arial">11. (1) If no application is made under rule 10 the sale shall become absolute.<o:p></o:p></span></i></p><p class="MsoNormal" style="margin-left:1.5in;text-align:justify"><i><span style="font-size:12.0pt;line-height: 115%;font-family:"Book Antiqua","serif";mso-bidi-font-family:Arial">(2) If an application made under rule 10 is dismissed, the court shall make an order confirming the sale.<o:p></o:p></span></i></p><p class="MsoNormal" style="margin-left:1.5in;text-align:justify"><i><span style="font-size:12.0pt;line-height: 115%;font-family:"Book Antiqua","serif";mso-bidi-font-family:Arial">(3) After a sale of immovable property becomes absolute or is confirmed under this rule, the court shall grant a certificate to the person who was declared the purchaser at the sale to the effect that that person has purchased the right, title and interest of the judgment debtor in the property sold. <o:p></o:p></span></i></p><p class="MsoNormal" style="margin-left:1.5in;text-align:justify"><i><span style="font-size:12.0pt;line-height: 115%;font-family:"Book Antiqua","serif";mso-bidi-font-family:Arial">(4). A certificate of purchase grante
