He sued the Respondent herein and the Lands Commission as 2<sup>nd</sup> and 1<sup>st</sup> Defendants respectively, in respect of lands he described as ‘Bundase lands’. The 1<sup>st</sup> Defendant (Lands Commission) only entered appearance to the writ but did not contest the action. It was only the Respondent (a limited liability company) that contested the action. The Appellant lost the action. He appealed against the judgment of the trial court to the Court of Appeal. He lost there too. He has now come before us on a second appeal.
