According to the plaintiff the parcel of land was gifted to him by his aunt Maame Koryo Wayo in 1995 after which a deed of gift was prepared on 10<sup>th</sup> February 2001 which he tendered as Exhibit A. The plaintiff testified that immediately after the gift of the land to him for which he provided aseda or thanks of Gh</span><span style="font-size:12.0pt;line-height:115%;font-family: "Cambria Math","serif";mso-fareast-font-family:"Yu Gothic UI Semilight"; mso-bidi-font-family:"Cambria Math"">⊄</span><span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua","serif";mso-fareast-font-family: "Yu Gothic UI Semilight";mso-bidi-font-family:"Times New Roman"">4.00 he entered thereon and planted food crops like plantain, maize and oil palm trees. In 1998 a brother of his aunt Maame Koryo Wayo called Teye Kwame sued him over the plot of land at the District Court in Koforidua but Teye Kwame lost the suit so in 2005 he the plaintiff put up a house with a drug store in front on the land. Whilst he was building the 1<sup>st</sup> defendant was also developing his adjoining plot No. 65 but the 1<sup>st</sup> defendant later laid adverse claim to his land and trespassed four (4) feet into his land as a result of which he sued the 1<sup>st</sup> defendant at the District Court Koforidua in 2009. During the pendency of the case the Public Works Department and the New Juaben Municipal Assembly served notices on the plaintiff and threatened to pull down his buildings because he had no title deeds and building permit. At that stage he caused a search to be made at the Lands Commission where he learnt that his aunt Maame Koryo Wayo and her brother Teye Kwame together with Dede Nartekie had sold his land to the 1<sup>st</sup> defendant in 2001. He realized that the 1<sup>st</sup> defendant was colluding with the 2<sup>nd</sup> defendant to take his land from him so he caused his solicitors to write to them but soon thereafter, the defendants, using the 2<sup>nd</sup> defendant’s pay loader and workers went and demolished his dwelling house and chemical store in which there were drugs together with his domestic animals all worth Gh</span><span style="font-size:12.0pt;line-height:115%;font-family:"Cambria Math","serif"; mso-fareast-font-family:"Yu Gothic UI Semilight";mso-bidi-font-family:"Cambria Math"">⊄</span><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"; mso-fareast-font-family:"Yu Gothic UI Semilight";mso-bidi-font-family:"Times New Roman"">98,03.00 hence his claims.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"; mso-fareast-font-family:"Yu Gothic UI Semilight";mso-bidi-font-family:"Times New Roman""><o:p> </o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"; mso-fareast-font-family:"Yu Gothic UI Semilight";mso-bidi-font-family:"Times New Roman"">The 1<sup>st</sup> defendant’s case was that he first bought plot No. 65 from Teye Kwame in 2001 and later acquired plot No 64 from Maame Koryo Wayo and Madam Dede Nartike who were sisters. He took possession of the two plots and proceeded to obtain a site plan and indenture which he registered at the Lands Commission in Koforidua. The 1<sup>st</sup> defendant stated that he obtained a building permit and started building before the plaintiff started building on his plot No 64. The 1<sup>st</sup> defendant testified that he warned the plaintiff not to build but he persisted so he reported this to the New Juaben Municipal Assembly who demanded the documents of title and building permits from them but when the plaintiff could not provide his, the Assembly demolished the plaintiff’s buildings on plot No 64. The 1<sup>st</sup> defendant denied that he was responsible for the demolition of the plaintiff’s buildings or that the buildings and their contents cost Gh</span><span style="font-size:12.0pt; line-height:115%;font-family:"Cambria Math","serif";mso-fareast-font-family: "Yu Gothic UI Semilight";mso-bidi-font-family:"Cambria Math"">⊄</span><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"; mso-fareast-font-family:"Yu Gothic UI Semilight";mso-bidi-font-family:"Times New Roman"">98,038.00. The 1<sup>st</sup> defendant contented that the plaintiff’s act of putting up structures on his land contrary to statutory requirements and warnings from the Municipal Assembly who sinned against public policy so the plaintiffs’ claims should be dismissed.
