The land the subject matter of this action is situate and lying at Essipon in the Sekondi-Takoradi municipality.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0cm;margin-bottom:.0001pt;text-align: justify;line-height:150%"><span style="font-size:12.0pt;line-height:150%; font-family:"Book Antiqua",serif"><o:p> </o:p></span></p><p class="MsoNormal" style="margin-bottom:0cm;margin-bottom:.0001pt;text-align: justify;line-height:150%"><b><u><span style="font-size:12.0pt;line-height:150%;font-family:"Book Antiqua",serif">Facts:<o:p></o:p></span></u></b></p><p class="MsoNormal" style="margin-bottom:0cm;margin-bottom:.0001pt;text-align: justify;line-height:150%"><span style="font-size:12.0pt;line-height:150%; font-family:"Book Antiqua",serif">The facts which engendered this appeal are as follows:- The Plaintiff was born in Ghana to a Greek father and a Ghanaian mother. The father of the Plaintiff was Andrews Karyavoulas who passed into eternity.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0cm;margin-bottom:.0001pt;text-align: justify;line-height:150%"><span style="font-size:12.0pt;line-height:150%; font-family:"Book Antiqua",serif"><o:p> </o:p></span></p><p class="MsoNormal" style="margin-bottom:0cm;margin-bottom:.0001pt;text-align: justify;line-height:150%"><span style="font-size:12.0pt;line-height:150%; font-family:"Book Antiqua",serif">In or about 1956, the said Andrews Karyavoulas (deceased) and the Plaintiff acquired a large tract of land the subject-matter of this appeal from the Royal Abrashiem Ebiradze Stool family of Essipon for valuable consideration in the sum of Thirty Pounds (£30.00). The grant was in the form of a lease for a period of 65 years. The transaction was reduced into writing and the land was plotted and registered in the then Lands Department in the Deeds Registry, Accra. Not long after the acquisition of the land, the Plaintiff’s father Andrews Karyavoulas who was in Ghana subsequently travelled to Greece for medical attention and died there. Upon his death, all the assets of the father devolved to the son the Plaintiff.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0cm;margin-bottom:.0001pt;text-align: justify;line-height:150%"><span style="font-size:12.0pt;line-height:150%; font-family:"Book Antiqua",serif"><o:p> </o:p></span></p><p class="MsoNormal" style="margin-bottom:0cm;margin-bottom:.0001pt;text-align: justify;line-height:150%"><span style="font-size:12.0pt;line-height:150%; font-family:"Book Antiqua",serif">While the Plaintiff was away in Greece, his mother who is still living in Ghana was instructed by him to take possession of the land which was leased to him in 1956, a portion of which is in dispute, and secure same from trespassers. In furtherance of abiding by the instructions of her son, Plaintiff’s mother who is Plaintiff’s attorney in the prosecution of this case in the court below, took over the land and cultivated same with coconut and food crops. All these farming activities took place without interference from any quarters whatsoever. Later on the Essipon area became statutory planning area, for which reason all the lands in the area, including the disputed land were demarcated into residential plots.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0cm;margin-bottom:.0001pt;text-align: justify;line-height:150%"><span style="font-size:12.0pt;line-height:150%; font-family:"Book Antiqua",serif"><o:p> </o:p></span></p><p class="MsoNormal" style="margin-bottom:0cm;margin-bottom:.0001pt;text-align: justify;line-height:150%"><span style="font-size:12.0pt;line-height:150%; font-family:"Book Antiqua",serif">The further case of the Plaintiff is that about six years ago, he returned to Ghana to develop the disputed land into a beach resort. Warning signs with the inscription that the disputed land belonged to the Plaintiff and his family in an attempt to warn of trespassers off was visibly displayed on the land. While preparing for the beach resort project, the 1<sup>st</sup> Defendant trespassed onto the land in particular plots numbers T1 and T2 and started digging foundation trenches thereon. All warnings to 1<sup>st</sup> Defendant to keep off the land was ignored.
