There are no <b>section 73 of Act 459</b> consideration in this matter. This is an application for bail pursuant to <b>section 96 of Act 30</b>. <o:p></o:p></span></p><p class="MsoNoSpacing" style="text-align:justify;line-height:115%;tab-stops: 4.5pt"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif"> </span></p><p class="MsoNoSpacing" style="text-align:justify;line-height:115%;tab-stops: 4.5pt"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif">It is trite that the position of the law is as couched in <b>Article 19(c) of the 1992 Constitution</b>. This means that there is a presumption of the innocence in all criminal proceedings. <o:p></o:p></span></p><p class="MsoNoSpacing" style="text-align:justify;line-height:115%;tab-stops: 4.5pt"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif"> </span></p><p class="MsoNoSpacing" style="text-align:justify;line-height:115%;tab-stops: 4.5pt"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif">What the court is called upon to do at this juncture is to engage in an analysis pursuant to <b>Section 96 (5) (a – d) of Act 30</b>. The court must bear in mind <b>Section 96 (5) (a) of Act 30</b> whilst coming its conclusion. <o:p></o:p></span></p><p class="MsoNoSpacing" style="text-align:justify;line-height:115%;tab-stops: 4.5pt"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif"> </span></p><p class="MsoNoSpacing" style="text-align:justify;line-height:115%;tab-stops: 4.5pt"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif">The court has heard from counsel for the accused though he has been urged with some difficulty to limit the bail application to the criteria assessable by law being <b>Section 96 (6) (a - f) of Act 30</b>.<o:p></o:p></span></p><p class="MsoNoSpacing" style="text-align:justify;line-height:115%;tab-stops: 4.5pt"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif"> </span></p><p class="MsoNoSpacing" style="text-align:justify;line-height:115%;tab-stops: 4.5pt"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif">I have considered the nature of the application and the severity of punishment which these charges if founded are likely to elicit. It has been canvassed that the accused person is recently a national service person, that is neither here nor there as the position of national service man does not have attached to it any sense of permanency or stability. <o:p></o:p></span></p><p class="MsoNoSpacing" style="text-align:justify;line-height:115%;tab-stops: 4.5pt"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif"> </span></p><p class="MsoNoSpacing" style="text-align:justify;line-height:115%;tab-stops: 4.5pt"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif">It has also been canvassed for the accused that he has a fixed place of abode. At this juncture I have borne in mind the submissions by prosecution leading me to conclude that there is potential for the accused to be a flight risk. However, no concrete information has been tendered to that effect. Nevertheless the greatest mandate of a court in a bail application is to ensure that the accused person would be present to stand trial as and when required. No matters have been canvassed about the likelihood of matters involving <b>Section 96 (3) (b, c) of Act 30</b>. <o:p></o:p></span></p><p class="MsoNoSpacing" style="text-align:justify;line-height:115%;tab-stops: 4.5pt"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif"> </span></p><p class="MsoNoSpacing" style="text-align:justify;line-height:115%;tab-stops: 4.5pt"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif">The court is mindful of the fact that bail should not be withheld as a punishment given our jurisprudential approach to crime.
