It is the plaintiff’s case that the said Florence Ayitey in her lifetime, on or about the 24<sup>th</sup> day of October 2002, purchased two plots of land identified as Block 53, plots 5 and 6 from the defendant Company at a cost of Forty Two Million Five Hundred Thousand Old Cedis (</span><span style="font-size:12.0pt;line-height:150%;font-family:"Times New Roman",serif">₵</span><span style="font-size:12.0pt;line-height:150%;font-family:"Book Antiqua",serif; mso-bidi-font-family:"Times New Roman"">42,500,000.00) now Four Thousand Two Hundred and Fifty Ghana Cedis (GH</span><span style="font-size:12.0pt; line-height:150%;font-family:"Times New Roman",serif">₵</span><span style="font-size:12.0pt;line-height:150%;font-family:"Book Antiqua",serif; mso-bidi-font-family:"Times New Roman"">4,250.00), which she fully paid for. She further paid an amount of Five Hundred United States Dollars (US$500) for provision of electricity to the site. The plaintiff asserts that the above payments represent the total payment her daughter had to make to the defendant and she was never required to make any further payments in respect of the properties.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0cm;text-align:justify;line-height: 150%"><span style="font-size:12.0pt;line-height:150%;font-family:"Book Antiqua",serif; mso-bidi-font-family:"Times New Roman""> </span></p><p class="MsoNormal" style="margin-bottom:0cm;text-align:justify;line-height: 150%"><span style="font-size:12.0pt;line-height:150%;font-family:"Book Antiqua",serif; mso-bidi-font-family:"Times New Roman"">The plaintiff further avers that her deceased daughter after purchasing the plots from the defendant company was unable to develop the land until her unfortunate death on 17<sup>th</sup> August 2004. Upon her daughter’s death, she applied for and was granted Letters of Administration by the High Court, Kumasi, to administer her deceased daughter’s estate. She made representations to the defendant for the refund of monies paid by her deceased daughter to the defendant company in respect of the said properties. Although the defendant initially agreed to refund the monies, the defendant later reneged on its promise and the defendant is still adamant on refunding the monies to the plaintiff despite numerous calls, visits and demands made on them including serving the defendant with about four demand notices. <o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0cm;text-align:justify;line-height: 150%"><span style="font-size:12.0pt;line-height:150%;font-family:"Book Antiqua",serif; mso-bidi-font-family:"Times New Roman""> </span></p><p class="MsoNormal" style="margin-bottom:0cm;text-align:justify;line-height: 150%"><span style="font-size:12.0pt;line-height:150%;font-family:"Book Antiqua",serif; mso-bidi-font-family:"Times New Roman"">It is the plaintiff’s further case that the defendant rather re-entered the said lands on 1<sup>st</sup> July, 2007 without notice to her and the defendant has demonstrated an unwillingness to refund the said monies to the plaintiff unless compelled by the powers of the court. The plaintiff therefore granted a Power of Attorney to her son Emmanuel Bonsu to do all that is legally possible to collect the said monies from the defendant company. It is the plaintiff’s case that the present value of the land is US$30,000.00 per plot.
