After the payment of the initial consideration, the defendant duly transferred the land to the 1<sup>st</sup> plaintiff and this is evidenced by a deed of assignment dated 11<sup>th</sup> April 2013 which was tendered in evidence as exhibit A. <o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0cm;text-align:justify;line-height: 150%"><span style="font-size:12.0pt;line-height:150%;font-family:"Book Antiqua",serif; mso-bidi-font-family:"Times New Roman""> </span></p><p class="MsoNormal" style="margin-bottom:0cm;text-align:justify;line-height: 150%"><span style="font-size:12.0pt;line-height:150%;font-family:"Book Antiqua",serif; mso-bidi-font-family:"Times New Roman"">The 1<sup>st</sup> plaintiff asserts that he had difficulties paying the remaining balance of GH</span><span style="font-size:12.0pt;line-height:150%;font-family:"Times New Roman",serif">₵</span><span style="font-size:12.0pt;line-height:150%;font-family:"Book Antiqua",serif; mso-bidi-font-family:"Times New Roman"">500,000.00 and further developing the land and he thus allowed some squatters who had been put on the land by the defendant to remain on the land and further agreed with the defendant to protect the land for him until he pays the outstanding amount.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0cm;text-align:justify;line-height: 150%"><span style="font-size:12.0pt;line-height:150%;font-family:"Book Antiqua",serif; mso-bidi-font-family:"Times New Roman""> </span></p><p class="MsoNormal" style="margin-bottom:0cm;text-align:justify;line-height: 150%"><span style="font-size:12.0pt;line-height:150%;font-family:"Book Antiqua",serif; mso-bidi-font-family:"Times New Roman"">The 1<sup>st</sup> plaintiff asserts that he entered into an agreement with the 2<sup>nd</sup> plaintiff to dispose off the land with the aim of using part of the consideration to settle his indebtedness to the defendant so that he could get vacant possession of the property. The defendant however refused to give vacant possession to the 1<sup>st</sup> plaintiff after knowing about the agreement between the plaintiffs and he demanded for more money (US$450,000.00) before he would give vacant possession to the 1<sup>st</sup> plaintiff. The plaintiffs agreed to pay the defendant US$230,000.00 in full and final settlement of the 1<sup>st</sup> plaintiff’s indebtedness but the defendant refused the offer and he still refused a further offer of US$300,000.00.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0cm;text-align:justify;line-height: 150%"><span style="font-size:12.0pt;line-height:150%;font-family:"Book Antiqua",serif; mso-bidi-font-family:"Times New Roman""> </span></p><p class="MsoNormal" style="margin-bottom:0cm;text-align:justify;line-height: 150%"><span style="font-size:12.0pt;line-height:150%;font-family:"Book Antiqua",serif; mso-bidi-font-family:"Times New Roman"">The plaintiffs aver that the defendant has allowed a third party to come onto the land with the aim of developing it and it is only an order of the court that will prevent the defendant from resiling from the valid agreement between him and the 1<sup>st</sup> plaintiff. The plaintiffs assert that all attempts to bring the defendant to the negotiating table and to amicably resolve the issue have proved futile.
