The said lease was registered at the Deeds Registry and indexed as No 1383/76.<o:p></o:p></span></p> <p class="MsoBodyText" style="line-height:115%"><span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua",serif"> </span></p> <p class="MsoBodyText" style="margin-right:7.4pt;text-align:justify;line-height: 115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif">Subsequently, by a Memorandum of Understanding dated 20<sup>th</sup> May 2005 made between Akweinas Farms & Company and Nii Larbi Mensah, Ablekuma Mantse<span style="letter-spacing:2.0pt"> </span>and Atofotse of Sempe Stool (a.k.a) Adjin Tetteh),<span style="letter-spacing:2.0pt"> </span>the parties agreed to vary the use of the land from agricultural to residential purposes for the unexpired residue of the head lease.<o:p></o:p></span></p> <p class="MsoBodyText" style="line-height:115%"><span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua",serif"> </span></p> <p class="MsoBodyText" style="margin-right:7.25pt;text-align:justify;line-height: 115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif">By a Deed of Assignment dated 22<sup>nd</sup> June 2005, Akweinas Farms & Company<span style="letter-spacing:-.05pt"> </span>purported to assign a section of the land it acquired from the Ablekuma Stool to the Plaintiff, Pro-Uma Tanko. The Plaintiff claimed that prior to the variation of the land use from agricultural to residential purposes, he had already taken possession of the land that he acquired from Akweinas Farms which is the subject matter of this dispute, by constructing a two room structure on it.<o:p></o:p></span></p> <p class="MsoBodyText" style="line-height:115%"><span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua",serif"> </span></p> <p class="MsoBodyText" style="margin-right:7.55pt;text-align:justify;line-height: 115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif">According to the Plaintiff, the Defendants caused the two rooms that he had constructed on the<span style="letter-spacing:.95pt"> </span>land<span style="letter-spacing: 1.05pt"> </span>in<span style="letter-spacing:1.0pt"> </span>dispute<span style="letter-spacing:.95pt"> </span>to<span style="letter-spacing:1.05pt"> </span>be<span style="letter-spacing:.95pt"> </span>demolished,<span style="letter-spacing: 1.05pt"> </span>chased<span style="letter-spacing:1.05pt"> </span>away<span style="letter-spacing:.9pt"> </span>his<span style="letter-spacing:1.0pt"> </span>caretakers<span style="letter-spacing:1.05pt"> </span>with<span style="letter-spacing:.95pt"> </span>the<span style="letter-spacing:1.05pt"> </span>support<span style="letter-spacing:1.05pt"> </span>of<span style="letter-spacing:1.05pt"> </span><span style="letter-spacing: -.2pt">land </span>guards, constructed a fence wall around the land and were in the process of digging a foundation. He therefore prayed for declaration of title to the land in dispute, recovery of possession, damages for trespass and perpetual injunction against the Defendants.
