The Plaintiff applied for and obtained judgment in default of appearance against the Defendant and proceeded to serve the Defendant with a witness statement by substituted service. The Defendant did not respond to any of the court processes that were served on him by substituted service. As a result, the Plaintiff proceeded to prove his claim on the authority of <b><i><u>Conca Engineering v</u> <u>Moses</u> (1984 – 86) 1 GLR 319</i></b>.<o:p></o:p></span></p><p class="MsoBodyText" style="margin-top:0cm;margin-right:16.05pt;margin-bottom: 0cm;margin-left:18.65pt;margin-bottom:.0001pt;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif"> </span></p><p class="MsoBodyText" style="margin-right:16.05pt;text-align:justify;line-height: 115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif">The Plaintiff’s case, as presented in his witness statement which was filed on 1<sup>st</sup> October 2018, was that in 2011, he acquired the land in dispute from Nii Otu Akwetey IX of Katamanso; however, a lease was executed by the parties in March 2014.
