Therefore, under order 17 rule 2 (1) of C.I. 47, the Plaintiff was entitled to discontinue the suit without leave of the court.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span lang="EN-GB" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">However upon filing the notice of discontinuance and serving same on counsel for the Defendants it is the opinion of this court that the Defendants were entitled to the costs of the action. In this case, they only filed a notice of appearance.
