The 4<sup>th</sup> Defendant who is one of the Directors of the 1<sup>st</sup> Defendant Company, by a deed of guarantee, expressly guaranteed the repayment of all sums due under the said credit facility given to the 1<sup>st</sup> Defendant. The 5<sup>th</sup>, 6<sup>th</sup>, 7<sup>th</sup> Defendants also executed the deed of guarantee.<o:p></o:p></span></p><p class="MsoNoSpacing" style="text-align:justify;line-height:115%"><span lang="EN-GB" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"; mso-bidi-font-family:"Times New Roman""><o:p> </o:p></span></p><p class="MsoNoSpacing" style="text-align:justify;line-height:115%"><span lang="EN-GB" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"; mso-bidi-font-family:"Times New Roman"">The 1<sup>st</sup> Defendant was unable to settle its indebtedness with the Plaintiff causing the Plaintiff to issue a Writ of Summons against the 1<sup>st</sup>, 2<sup>nd</sup>, 3<sup>rd</sup>, 4<sup>th</sup>, 5<sup>th</sup>, 6<sup>th</sup> and 7<sup>th</sup> Defendants. The trial having travelled over a period of six (6) years, Judgment was delivered on the 23<sup>rd</sup> March, 2018 in favour of the Plaintiff. The factors which a Court should consider to set aside a Judgment was given consideration by the Court of Appeal in the case of <b>ALPHONESO ARYEETEY & ANOR. v ROYAL INVESTMENT CO. LTD & 18 ORS (CIVIL APPEAL NO. HI/201/2005, November 29, 2005)</b>, where the Court stated that:<o:p></o:p></span></p><p class="MsoNoSpacing"
