I have read the application and the supporting affidavit. I have also read the affidavit in opposition. I have given consideration to the principles governing the grant or otherwise of applications of this nature.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span lang="EN-GB" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"; mso-bidi-font-family:"Times New Roman"">I must say that upon reading the affidavit in support of the application I find no justification for the filing of the present application. There is no matter pending in any Court in respect of the judgment which the Defendant/Applicant seeks to stay its execution. No appeal or review is pending. There is also no process pending for determination to warrant the filing of this application. The only reason which the Defendant/Judgment Debtor/Applicant gave for the stay is that he wants to pay the judgment debt by instalment. I am of the view that the factors which a Court will consider to either grant or refuse applications of this nature does not include the desire of a debtor to pay the debt by instalment.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span lang="EN-GB" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"; mso-bidi-font-family:"Times New Roman"">It is noted that when this matter came before the Court on the 6<sup>th</sup> June 2018, the Court advised the Defendant/Judgment Debtor/Applicant to negotiate the payment of the debt with the Plaintiff/Judgment Creditor. The matter was subsequently adjourned to today. Unfortunately, the Defendant/judgment Debtor/Applicant failed to meet the Plaintiff/Judgment Creditor/Respondent as advised by the Court.<o:p></o:p></span></p><p> </p><p class="MsoNormal" style="text-align:justify"><span lang="EN-GB" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"; mso-bidi-font-family:"Times New Roman"">I have no other option than to dismiss the application as it lacks merit. Accordingly, the application is dismissed. I make no order as to costs.<o:p></o:p></span></p></span>
