The rationale for the present application is as pleaded in the amended statement of defence and counterclaim of the 2<sup>nd</sup> Defendant per the paragraphs 9, 10, 11, 12, 13, 14, 15, 16, 17, 18 and 19 thereof.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span lang="EN-GB" style="font-size:12.0pt;line-height:105%;font-family:"Book Antiqua","serif"; mso-bidi-font-family:"Times New Roman"">I have read the application and the affidavits filed in support and in opposition. I have also considered the oral submissions made by Counsel for 2<sup>nd</sup> Defendant/Applicant and Counsel for Plaintiffs. Regard has been given to the Order 4 Rule 5 of C.I 47.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span lang="EN-GB" style="font-size:12.0pt;line-height:105%;font-family:"Book Antiqua","serif"; mso-bidi-font-family:"Times New Roman"">I have also carefully examined the reliefs being sought by the Plaintiffs for which the 2<sup>nd</sup> Defendant wants the Court to join Dominic Adu so that he answers those claim. I must say that looking at the reliefs, being claimed by the Plaintiff, it would be fundamentally difficult for the said Mr. Adu to be joined as a Defendant. This is so because, from the pleadings of the 2<sup>nd</sup> Defendant, he said Mr. Adu is rather in bed with the Plaintiffs.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span lang="EN-GB" style="font-size:12.0pt;line-height:105%;font-family:"Book Antiqua","serif"; mso-bidi-font-family:"Times New Roman"">Unless the reliefs being sought by the Plaintiffs are such that when the person is joined, it will afford the person to answer the reliefs and pleadings related there to, it would be absurd and unconscionable for the Court to make such orders. This is because upon the service of the amended writ by reason of the joinder, the person who is joined as a Defendant, upon service must file an appearance and also file a statement of defence.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span lang="EN-GB" style="font-size:12.0pt;line-height:105%;font-family:"Book Antiqua","serif"; mso-bidi-font-family:"Times New Roman"">In the instant case all the allegations made against Mr. Adu are contained in the statement of defence of the 2<sup>nd</sup> Defendant. The Court recognises the seriousness of the allegations made against the said Mr. Adu by the 2<sup>nd</sup> Defendant in the statement of defence.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span lang="EN-GB" style="font-size:12.0pt;line-height:105%;font-family:"Book Antiqua","serif"; mso-bidi-font-family:"Times New Roman"">However, this cannot be a basis for the Court to join the said Mr. Adu as a Defendant to the suit. It appears to me that the interest of 1<sup>st</sup> Plaintiff and Mr. Adu are the same though in different legal capacities. Order 4 Rule 5 (3) permits the Court to join a person as a Plaintiff with his consent or some other manner as may be authorised by the Court. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span lang="EN-GB" style="font-size:12.0pt;line-height:105%;font-family:"Book Antiqua","serif"; mso-bidi-font-family:"Times New Roman"">Having examined the entire pleadings of the Plaintiffs and that of the 2<sup>nd</sup> Defendant, it is my opinion that the joinder of Mr. Adu as a Plaintiff will serve a more useful purpose in the determination of the issues than to join him as a Defendant.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span lang="EN-GB" style="font-size:12.0pt;line-height:105%;font-family:"Book Antiqua","serif"; mso-bidi-font-family:"Times New Roman"">In the circumstance, I hereby join Mr. Dominic Adu, as a 3<sup>rd</sup> Plaintiff to the suit. Let the title of the suit be amended accordingly.
