As a means of enforcing the Judgment, the Execution-Creditors attached certain properties by a Writ of fi fa. Among the list of properties attached are two blocks of flats occupied by personnel of Ghana Police Service. The Ghana Police Service filed a Notice of Claim in respect of these two blocks of flats, culminating in the instant proceedings.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0in;margin-bottom:.0001pt;text-align: justify;line-height:115%"><span lang="EN-GB" style="font-size:12.0pt;line-height: 115%;font-family:"Book Antiqua","serif";mso-bidi-font-family:"Times New Roman"; mso-ansi-language:EN-GB"><o:p> </o:p></span></p><p class="MsoNormal" style="margin-bottom:0in;margin-bottom:.0001pt;text-align: justify;line-height:115%"><span lang="EN-GB" style="font-size:12.0pt;line-height: 115%;font-family:"Book Antiqua","serif";mso-bidi-font-family:"Times New Roman"; mso-ansi-language:EN-GB">The case of the Claimants is that in or about 2010, the Ghana Police Service acquired two uncompleted blocks of 12 flats numbered 8 and 10, Mount Afajato for the sum of <b>GH¢1,537,920.00</b> from the late Theodoro Martinez Montero. It is further the case of the Claimants that Ghana Police Service continued with the construction of the uncompleted blocks of flats and put Police Personnel in these flats.<o:p></o:p></span></p><p class="MsoNoSpacing" style="line-height:115%"><span lang="EN-GB" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"; mso-ansi-language:EN-GB"><o:p> </o:p></span></p><p class="MsoNormal" style="margin-bottom:0in;margin-bottom:.0001pt;text-align: justify;line-height:115%"><span lang="EN-GB" style="font-size:12.0pt;line-height: 115%;font-family:"Book Antiqua","serif";mso-bidi-font-family:"Times New Roman"; mso-ansi-language:EN-GB">It is the contention of the Claimants that the root of title of the properties in dispute had been with the Ghana Government. It is the further contention of the Claimants that the Government of Ghana compulsorily acquired the properties for the defunct Bank for Housing and Construction. The Bank for Housing and Construction then assigned the properties to Mr. Theodoro Martinez Montero. According to the Claimants, the said Theodoro Martinez Montero was the Managing Director of Redco Limited and owner of 40% shares in Redco Limited, through his company TEMSA. The Claimants therefore narrated the history of the acquisition of the property and contended that the property does not belong to Redco Limited for same to be attached in satisfaction of any debt owed by Redco Limited.<o:p></o:p></span></p><p class="MsoNoSpacing" style="line-height:115%"><span lang="EN-GB" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"; mso-ansi-language:EN-GB"><o:p> </o:p></span></p><p class="MsoNormal" style="margin-bottom:0in;margin-bottom:.0001pt;text-align: justify;line-height:115%"><span lang="EN-GB" style="font-size:12.0pt;line-height: 115%;font-family:"Book Antiqua","serif";mso-bidi-font-family:"Times New Roman"; mso-ansi-language:EN-GB">The Execution Creditors on their part contended that Mr. Theodoro Martinez Montero was incarcerated by the Government of Ghana in 1984 to serve a jail term in the Nsawam Prisons. On his return, Mr. Martinez Montero took out an Interpleader Summons against one of the attached properties belonging to Redco Limited in 2007. According to the Execution-Creditors, the Interpleader was filed by Montero through his Lawyers, Ntrakwah and Co. It is further contended by the Execution-Creditors that Mr. Montero lost the Interpleader action and appealed to the Court of Appeal.
